Italian court rejects Samsung’s request for iPhone 4S ban

Italian court rejects Samsung’s request for iPhone 4S ban
Back in October, Samsung filed for an injunction against the sale of the iPhone 4S in France and Italy on the grounds of, none other than, patent infringement. As we previously reported, France dismissed Samsung’s request back in the beginning of December. Unfortunately for Sammy, things in Italy are shaping up the same way.  Judge Marina Tavassi of the Tribunale di Milano, the Italian first-instance court for patent cases, has rejected the request for a preliminary injunction in Italy.

It looks like it’s on to the next one for the endless battle between Samsung and Apple.

I feel like this Patent wars are going to end up like Vietnam did for the USA: a complete waste. So far nothing has really been done, and its just a big pissing match. They need to stop it and focus on actually creating new things instead of battling it out in the court room.

Imo it doesn't matter anymore, this was just Samsung getting back at apple. Their devices are selling increasingly well and have alot more brand recognition now. If apple doesn't make a major change with their ios6 devices then I would be a bit worried for them. Good on Samsung, now they just need to make quality hardware, my focus is too plasticy !

Fight ridiculous patents with ridiculous patents. Too bad Sammy loses while the real ''innovative'' company wins!

well Sammy would have to come up with something original to win.

Apple sucks. Their products are made for people that don't even know how to turn on computers, let alone know how limited they are compared to other operating systems. Oh you just got tethering? - Android. You have a notification bar now? - Android. You have to pay for STORAGE? (lol) - Never on Android. Do I need to go on? Apple makes its money manipulating people into thinking their products are the best, when in reality, they are for dumbasses. Which is why it is so popular in America.

then how do they turn on their macs? sorry u think everyone in america is a dumbass but we have the power to choose between android and apple… nobody forces iphones on people… its not forced by the government or anyone.. people wnat apple products because they are alluring and function well… after 4 years my mac is still running great--how many pc computers function that well without hardware upadtes? very few… and if someone dosent want to buy a mac they dont have too…

u probably live somehwere other than america and obviously cant see the value in having choice...

lol, i love the retort about turning on the macs. dr. obvious pimp slappin.

that said
My PC is 4 years old and it runs perfectly. I dont install, believe in, or reccommend anti-virus programs to anyone. I recommend "dont be an idiot" with your PC. 99% of all PC problems are user created.
MacOS is an OS on a track that you cant deviate from. Less customizing means less ways to break it. Freedom & good decisions = responsibility.. and u can look around and see some people just are not good with responsibility.

And yea, it gets updates just the same as Windows does.

Totally agree, when I do install anti-virus software it slows down the PC. I use Microsoft essentials and MCAfee site advisor for chrome. I use piratesbay.org and firstrowsports.tv quite a bit, without any issues.

hm.. i find my mac has a lot of freedom but i guess many people might not if they dont find the right places… and i just love macs because they make everything nice.. im not saying they are better than pcs in evvery case, and i see the value of pcs, but i personally find macs to be much more useable.. and in my experience my mac has outlasted my windows computer by many years

Honestly, Macs are even worse than the iPhone. They don't even have programs that you can have on a PC, games aren't even used on Macs (rare). I still cannot fathom the fact that iPhones STILL DON'T HAVE FLASH. I've had a PC for a long time as well, and to top it off, it is a POS Acer and runs like it is brand new out of a box. Which further concludes my point that you don't need a masters degree in computers to operate/manage one.

I am fully aware that the government doesn't control products coming in and out in America, but at least tell people how buckled down you are when you use their products. Everyone that sees my GSII (that has an iPhone), says that they cannot stand the limitations you go through. No 4g, Apple takes out development apps in the store, no customization, toggles, small screen sizes, etc. I literally laughed out loud when I played with an iPhone after decking out my Galaxy S II. Why people buy Apple is beyond me. They don't have the resources like Android, and that is why they will take over. Not to mention Apple doesn't have Jobs anymore, so it will go to s**t before you know it.

wait are we talking about iphones or macs? because macs have flash just sayin…. and idk if u have a mac but they have a lot of games.. not as many as pc but why not just use an xbox/ps3.. the games are better-- and if u r really that hardcore of a gamer then get an alienware (but its kind of specialized)…

hm go to s**t before i know it… well technically i cud never know it before its been done so valid point.. but unrealistic all the same… tech companies dont just fail when their ceo leaves… micrsoft still survives.. toyota.. mercedes? they all survive with different heads… and saying that about an iphone is just like me saying how i hate the lagginess on android, the lack of updates, how "customization" is moving a few widgets around unless rooting is involved in which case an iphone could alternatively easily be jailbroken… i laugh when ur phone lags on a scrolling.. i laugh when im playing infinity blade.. i laugh when i can go to any apple store and have them repair my phone…

basically to everyone their own but u cant say ios has absolutely nothing while android is just the laggy god of the mobile world

Not to be an idiot, but I put in bold letters that the iPhones still do not have flash. The Macs do not have programs (a lot) that you can only run on a PC. I was just being specific with what limitations you have on a Mac.

I do own a console for gaming, and if I wanted to; I would build my own computer, run it at max settings, and outperform a Mac, while spending about $1,000 less. But like I said, I do have a console. (Broke college student)

A far as "moving a few widgets around", that doesn't even flow with my point. I use one screen on my Android, and use gestures (double tap, swipe up, swipe down) to access different parts of my OS (show notifications, open app drawer, open a specific app, etc.) Every time you want to turn off WiFi, GPS, or even Bluetooth on the iPhone, you have to go to the settings. On Android, you can eliminate that completely with just a couple of toggles. Another form of customization (that I like), is the different clocks that you can put on the home screen. From analog, flip, digital, you cant go wrong.

This even gets better with rooting your phone, which I am not going to even discuss.

I say iOS will fail (not in terms of sales, but in expanding their horizons with their OS), because Steve would monitor EVERTHING that other people wanted to do to his work. For example, SD Card is not included, WiFi kill, controlling computers from your phone (lol) will never be in Apple products.

I'm not too sure on what you mean by Android lagging. My phone doesn't lag, unless I were to underclock it too much. The main reason iOS can say that "they don't lag", is because they use fast app switching. Which is a BS excuse to call it multi tasking still, because everything closes when you exit the app.

You laugh when you take your phone to an Apple store? Tell me this, why do you think Apple makes their phones out of glass? So people can drop them, and pay them more money to fix it. Want to know what happens when you lose your phone? You buy a new one, $600.00 later you have your precious iPhone back. Jailbreaking an iPhone is NOTHING like an Android. You just have access to a market that is already built into Android, and if you "jailbreak it", there is no going back. Which basically means, you're screwed if you have to go to the Apple store. My Android can go to complete stock in 5 minutes tops (full system restore) using Odin.

Limitations Lucas77, limitations.

if u r unaware, there is a program called wine/winebottler which turns any pc app into a native osx app.. plus windows can be run on any mac.. and i suppose i just dont understand why u arbitrarily stated iphones cant have flash which is not entirely true because there is an app called thrash i believe in cydia

yes i know building a computer is quite grand.. but not everybody can.. and many people want the support/simplicity mac provides

and what u r sayng is quite untrue for ios.. look up activator/sbs settings--quick access to everything u say… ever heard of logmein? i control my computer from wherever i am… sd card for me personally is not a big issue but i do see how some people (although a limited amount), wud want it.. i do not think android is bad, it functions different services than the iphone, but it is not black/white no customization/customization features/no features as u describe

i have tested numerous android phones--even had a captivate which i was told was quite a good android phone and it lagged.. what is so terrible about fast app switching? it is perfect for me-- and if u dont like it, backgrounder offers the same function of "android multitasking"

haha i have dropped my phone so many times its ridiculous and it is fine-- but i do have a case on it.. which i wud do for any phone.. i am firm believer that things are better without cases, but it drives me crazy to use stuff with dings in it so i often use sleeves--not convenient with a phone.. and i like the apple sotre because if anything goes wrong i can simply ask them to help me.. and frankly they are much more helpful than anyone at a cell phone store was for me

u see, jailbreaking makes iphone quite similar to android--just with beter apps.. no u cant load roms, but i prefer stock android to roms anyways so it wudnt make a difference to me.. there is definitely turning back.. ever heard off the restore button in itunes? iphone is back to stock immediately… u can back up to a copy of pre-jailbreak or (i normally do this) just sync all my data-- icloud even gives u the apps in the exact same state u left them

i get the feeling u havent used/jailbroken an iphone before..

All right, I say ban other company product is total absurb and childish ...... Itaty make a right call and i think every country should reject ban idea so money can spend on something better like create instead destroy.

definately not true… what is the incentive to create and innovate if someone is just going to copy ur work and therefor u really arent making very much money because the wealth is all spread out… its the joys of capitalism-- we need the patent system

i have been observing this for some time now and it seems true. apple products especially the iphone are only popular and commonly used by americans. not that am hating but it seems americans are just trying to be loyal to their home companies. in africa iphones are not popular not because of price but people just dont fancy it. samsung, blackberry, htc and nokia phones are the popular once here. the price of an old htc inspire/ desire hd is equall to that of an iphone 4 yet htcs and samsungs r more popular.

Although patents come involved in these legal battles, I honestly do not think that any high-end smartphone should be banned in any country, due to a request from a competitor.
AND seriously, its FRANCE and ITALY!!!, It be ridiculous to ban there

So Apple ban Samsung in certain countries but Italy wont give Samsung its request for ban on iPhone 4s. This is a lot of b.s. if you ask me.
