Judge sets September 20th date for hearing on preliminary injunctions; Apple is grateful

0. phoneArena posted on 24 Aug 2012, 22:33

While the verdict has been spelled out in terms of dollars and cents, there still is the matter of Apple's request for injunctions on certain Samsung phones; Apple has until the 29th to file a motion, Samsung has 14 days to respond followed by 2 more days for Apple to once again reply...

I choose to look at this in another manner reality to now. Whatever happened happened this is all about 2plus year old devices that aren't being sold anymore. So ban them Samsung made its money already life goes on. This isn't about today's products that are on the market and KICKING APPLE'S ASS like the Galaxy S3, Galaxy Note, the upcoming Galaxy Nexus 2 or Galaxy Note 2 those are the products people have today and will buy tomorrow. Clearly Samsung has done a wonderful job with it's current products and the future is bright that's why Apple is making all this out to be so dreadful. Samsung has BITCH SLAPPED APPLE SENSELESS FOR YEARS and have exposed apple products for exactly what they are a total BORE. Nothing in this court proceedings hurts it's current fleet of devices...http://www.droiddog.com/android-blog/2012/08/editorial-apple-successfully-wins-against-samsung-and-what-this-probably-means/?utm_source=dlvr.it&utm_medium=facebook

Your post is just as hollow as Samsung's arguments in the case.

The point you missed is that Apple had to drop other claims to proceed with this case. What I am saying is Apple is just getting started and Samsung's best arguments were shot to dung. Apple has far more claims against Samsung.

I don't think the android fan camp got the memo -- this is just the beginning of a long nightmare for Samsung. It gets worse from here. The biggest win Apple got was a precedent --- and in this case, it was an OVERWHELMING slam dunk -- against the Samsung in this long war. It's not over by a longshot. The Apple legal team is now preparing to file the other claims they had to drop.

Samsung executives are now crapping in their pants. The Mobillty Unit rolled the diced and proceeded to pissed off one of their best and most profitable customers. What people don't realize was that it was Apple that gave Samsung and other OEMs billions in advance payments to build their factories.

You forgot, "Nightmare for Samsung" in the US. Only the Court in US is biased enough to side with their own company instead and doing what is fair. Everywhere else, Korea, Australia, Britain, have been very fair with this case, making both sides lose, Samsung to Apple's rectangle patent and Apple to Samsung's 3G patents.

In the US, Apple's rectangle patent got thru but Samsung's 3G ptent didn't? WTF? By the jury's logic I supposed 3G appeared at the same time or before the rectangles which Apple "invented", right?

Whatever it is, the worst that could happen is Samsung pulling out of US completely, getting sick of Apple's s**t. Besides, Samsung has been making other electronics like TVs, refrigerators and others, Apple only has their crappy phones and tablet to stand on.

I'd say, if Apple had lost this round instead of Samsung, Apple would have been in a whole lot more trouble than Samsung is in right now. The phones Apple are seeing to ban are some old phones and tablets, all of which can be fixed with a software update, the latest S3 isn't even part of this. However if Apple had lost, Samsung could ban all iPhones, past and present and iPads that have 3G conncections.

thats exactly what happened in korea to apple. If samsung's patents are held up in appeal, that is a hardware issue that apple cant just send out an update to fix. that would be a massive blow to them to be banned in their own country.

Also, that's probably why it wont happen. your talking about a court system known to be a bit... wonky.. in California, where it is also Apple's home turf, where they were already in the business of buying favors from politicians. If apple gets banned it has a direct impact on their local economy. We just witnessed a bunch of 1 sided stuff from this case to prove the point. I doubt Samsung has a chance of getting their 3g patents protected from apple in the US because of that, but i dont think a lot of apple's patents will hold up on appeal either.

Samsung didn't hurt for that verdict because that 1 billion plus still Samsung can earn with that, from apple maybe it doubled for that amount because of Samsung is the supplier probably some major parts of apples product . Go Sammy just keep on innovating more just for the other sides of the world and not for the American.

in the meantime I am waging my private war against apple, I have convinced no less than 50 friends and family members to ditch apple's iphone and go android specifically S3, I migrated 2 today, usually SMS messages is the biggest thing that stops users jumping ship, I migrated my brothers and his wife tonight he had 7000+ messages that got moved with no problems. If there are people willing to help apple users ditch and jump ship they will do it. Apple will only learn if it hits their hip pockets and if we stop buying their products they might change their attitude, we can only hope though. My Goal is to help 100 users before the end of this year, I do this free of charge :-).

Samsung needs to file for a new judge or move it to the federal level. California is an obvious hostile enviorment I mean come on apple is based there putting the lawsuit there in a state that has a high iproduct usage on people that barely understand what a cell phone is and who probobly fell asleep during all this anyway was just complete garbage. They need to make the jury groups of tech people give them all the information lock them in a room for a week and come up with a verdict.

No, Samsung needs to take outside of the US in straight to the WTO or S.Korea, because of their Nationality, they will never win here against a home grown company like Apple; and we all know this.

Like someone frydaexiii...Apple's rectangle patent got thru but Samsung's 3G ptent didn't? WTF?.

I hope these juriust is reading these boards, because they made ALL of us look like we have no F-ing brain, to the WORLD.. (SMH)

Things are based on "jingoism" and not "natural justice". Can expect some fair play only if it gets down to fight between two American companies. Outside that jingoism will be the driving force ...

for all the people that keep saying "samsung needs to take it to korea"

do you not realize that the exact same trial happened in korea and finished this week as well with all iProducts being banned from the country... as well as pretty much all samsung products except for the SGS3.

Now that is MAD.. Mutually Assured Distruction.

And that is what I was hoping would happen here. Smack the crap out of both of them so they are forced to come to agreements without their head up their arse with crazy demands (apple) or trying to deny any wrong doing to begin with (samsung). Then it would be truly over. This is just another brick in the wall with this verdict.

I am one who thinks they should,

If you ask Samsung which one would had been fair, US decision vs Korea decision which one you think they will accept?.

Better yet, you are one of the few fair person that comment, do you think Samsung gotten a fair trial?.

Do you think this Judge was fair in 95% of her decision against Samsung?.

Do you think Apple (being the darling apple of alot of people eyes) have real invented technical patents?.

Now you see why Samsung need to file charges in their country.

And as far as,"MAD.. Mutually Assured Distruction", honestly, I think the Korean Judges try to be nice to Apple and the US, and I think WE all know the US get special treatment in the world...right?..hahahaha

If upholding Samsung's patent claims against apple and banning every apple device from being sold in Korea is "nice", I'd hate to see what mean is. lol

A company like Apple talking about how much they "value originality and innovation" and how "stealing isn't right"...I have never laughed harder in my life.

Apple, a company that, for years, has bought or used other companies' technology and claimed it as their own, claims they value originality and innovation. Are you nuts? Apple has barely created a single thing in their devices, but as long as they have the paperwork that says it's their technology (despite not making it themselves), they can't lose. It is a completely busted patent system in the United States. At least in other countries, Apple can't get away with that stuff as often.

I'm not saying that other companies aren't guilty of the same thing (Samsung, Motorola, HTC, and others)...but Apple is the company whose pride in all this tech they didn't create themselves goes unmatched. They love the fact that they can push people around because they have the power to sue whoever they want for whatever they want...for no justifiable reason.

This case is a big BS.... It is held and heard in San Francisco, in the heart of Silicon Valley, practically the backyard of Apple, Inc. Members of the jury who are no patent experts in the first place are from the bay area. Samsung should have asked to move the case somewhere else, maybe Chicago, NY or even a different country, anywhere where it is neutral... Just saying....
