Apple gets sued for delivering HD video to older Apple iPhone models

Apple has been sued in San Francisco by an attorney in Florida named Scott Weiselberg, who says that he was tricked into spending a $1 more to rent an HD version of "Big Daddy" even though his version of the Apple iPhone doesn't support HD movies; even though the first three versions of the Apple iPhone and Apple iPod touch do not support HD video, Apple made HD the default option when it launched iTunes 8.0 in 2010...

People get angry over anything. He does have a valid complaint though, but he shouldn't of gotten the HD if he knew his screen doesn't natively support it.

Unless he found out about the HD thing after the fact. People trust the curated nature of Apple, iTunes, and the App Store. Also, this part here - "Apple made HD the default option when it launched iTunes 8.0 in 2010." So again, he probably didn't even realize something was amiss; all the while being nickle and dimed.

Because of this lawsuit apple may now have to abandon plans to make an extra 5 bucks per movie out of the usual ifan masses by saying and charging all the movies as '3d'!!

You are absolutely correct, but at the same time Apple shouldn't be violating consumers trust by charging them extra for HD video if their devices don't support it.

That is right, I just hope consumers educate themselves better in the future, Apple isn't the only one who this could happen to.

i bought an app from the App Store about 1.5 year and after restoring my phone a month ago, i cant find this App anywhere on the App Store, since the app was so good, i bought one for a friend also about a year ago, so i used the 'Tell a friend' feature to send the link of the app from his phone to send the App Store linked to my email, clicked on the link and i got a message "this app doesnt exist in your region" am in the Nederland, why did Apple sell an app to me which doesnt exist in my country in the first place...i really need the app now but app is gone and so is my money. Ripoff

An iRiPoFF if you ask me - I've spent thousands on supposed "HD" movies and I ask you, "for what"? It really is a violation of Consumer Rights, I thought this was the "Land of the Free, Truth, Justice and the American Way"? I'm suing Apple too - I want my money back!

land of the free, but we have more laws than any other country. Truth, unless the government thinks another story would do better (IRS, PRISM, and Bengasi) Justice, via promoting or moving people around in the government when they should be in prison for lies and doing international harm via their government position. American way, 55% of Americans said no to the Cash For Clunkers, 70% said no to Obamacare you are fighting for something we gave up a while ago.

It never ceases to amaze me how foolish apple-ites are. My favorite is seeing those cases that are twice as thick as the silly phone with the dumb cutout just so folks know you're using a device that needs a tank of a case to keep it from falling apart.

Normal consumers of any Of tend to be uneducated. Not everyone is as well versed in tech-lingo as you and I are, it's not just apple. Yes, apple users may tend to be more of the older generations and may not be as knowledgeable as some of us who picked android, but that doesn't mean that they are dumb people.

Woah. Valid argument, through and through. Apple provides a good service, but this is a bit sketchy.

If you buy or rent it on iTunes, they have no idea what all devices you're going to be watching that on. You could be watching it on the computer, iPhone, whatever. Now if he rented it right on the iPhone, and it gives him a choice even though his phone doesn't support HD, that's a little different. And did he even try contacting iTunes support? I've heard they're usually pretty good about doing refunds or credits in these situations. The claim of fraud just makes this sound like a bunch of hot air.

i don't care if anyone sues Apples vaild or not they really deserve for all the stupid stuff they did last year, the year before that, and this year. Apple is just a slow ass company who says they don't want copying but its for them to do it like they own everyone and everything in the mobile space. Apple = Devil=Hades=villian in any super hero movie or a bad person in the world.

Sorry but you are stupid, and everyone that thumbed you up. What kind of reasoning is that? Apple should be sued for valid reasons, and so should Apple's lawsuit be shot down if it's invalid. It's one thing to not care about it, but to say anyone deserves unwarranted lawsuits just because they do unreasonable things? I hope thats just how you feel about Apple and not your life philosophy, otherwise I wouldn't want to run into you on the street, because you sound like someone with a screw loose. Oh, just to clarify, I read the article and I do agree that this is probably not an oversight, and Apple knew what was going on. In this case I do agree the complaint holds water. Now I understand. iPhone users are so gullible to begin with it's easy to take advantage of a 60 year old who doesn't know the difference between SD and HD. All those 3GS old timers got screwed.

What if your local gas station only displayed 93 octane but did not tell you that 87 octane was available unless you asked? Sure 93 octane will work but your wasting money because your car is not designed for 93 octane. Meanwhile some Middle East Oil Sheik is buying HD video on his gold plated iPhone 3GS with your money.
