Apple files another complaint with the International Trade Commission against HTC

0. phoneArena posted on 11 Jul 2011, 10:00

Since the first complaint against HTC is unlikely to hold water, Apple has filed another one, allegedly for different patents infringement this time, which might overlap with the complaint against Samsung...

Fact of the matter is that ALL current smart phone designs, especially those with touch screens, have most likely infringed on pattents long-held by the likes of Nokia or NorTel, who have been in the industry much longer than HTC, apple, or Samsung. There has been a long understanding amongst tech companies that the lines of IP rights in the smartphone industry are especially blurry and, therefore have refrained from filing many potentially frivolous lawsuits amongst each other (there are, of course, always exceptions). that is, until Apple entered the court room a few years ago. Apple has filed many such ridiculous and narrow minded claims against competitors, including one that read something like, Apple Inc. holds the rights to "unlocking the device by manipulating a movable image on the touchscreen." weather this is an issue for pattent law as a whole, or the industry, it is clear that such broad pattents (and hence, pattent disputes) will only harm competition and innovation in the industry and cannot realisticly be enforced in such a broad way. Apple is the only one who seems to have missed this idea, and they look like a two year old stomping their feet in the store when they dont get their way.

Instead of spending money to make their phone's more competitive, Apple is spending money to prevent the other manufacturers from selling their superior products.

Backwards logic, if you ask me. It's shows the arrogance of Apple.

Those aren't mutually exclusive. They're actually doing both.

if Apple wanted to make their phones more competetive . they would have... is not that they cant..they dont want to put products outthere without proven tenchology... look at al the phones having issues.. T-Bolt even the Droid charge thats just came out is alreadyhaving issues.... the antenagate might be the exception ... is mostly the lawyers being greedy and having time in their hand . so they sued people for fun.. or to explain the hight rates to Steve-O...

true thats why I stated that the antenngate was the exception other than that their technology is stable.. but my point here and thank you for reading my comments is that it may be the greedy lawyers that have the time to sue people left and right.. sorry for the sloppy writting..

apple is acting a like a spoiled kid, throwing all their toys out whenever someone has a better toy than them.

with the amount of android phones coming out from different companies, it seems apple will be playing catch up from now on. i don't see them being a tech leader in the smartphone market from this day forward. a company like samsung can release a phone that is way advance than anything they can come up with, and can release multiple versions of it. apple will only be able to get the tech if they bought it from them.

so they are scared, but they have aces on their sleeve as well. brand recognition and marketability. apart from that...nothing else. but those two are potent weapons.

Main problem is, all these lawyer costs, and patent fees. Who is going to pay for them.... CONSUMERS!

Who in Satans ass crack wants an iPhone now adays??? Apple seems like if it was trying to take away Android phones with midrange crappy iPhone 4s. Thier are pretty high end (andbetter) phones that are Android and Windows. I love i pods and stuff like that, but Apple is trying to take a diabolical fart that will take away the holy Androids. Give it a rest Apple!!

How pathetic is apple really getting,it was funny at first but now they really are pityfull. Apple is like a sad drunk at the end of the night trying to swing a legal punch at anybody in sight before it falls into its own sick while android owners point and laugh!!!

I really hope Apple wins these cases. So many copycats taking advantage of Apple's ideas. All they do is wait for Apple's next move and then copy it. Touchscreen phones weren't the big thing before 2007 when the first iphone came out. And now look at all these touchscreen phones. Yet, android fanboys say that there's no copying? Please. When the ipad was released, no manufacturer cared to produce tablets, but now look at all the tablets that's been coming out lately. And yet again, fandroids say that there's no copying, lol. Before the AppStore came out, no one made a big deal of application stores. But now look at all the application stores. And yet again, the fandroids deny the copying. It's so obvious that Apple creates the trends and the rest are just imitating, yet fandroids seem to have no clue about it, or they're plainly playing DUMB.

Apple made touch screens MORE popular, not popular in the first place.

I agree with you on the tablets thing, didn't hear much about tablets before the iPad.

Apps have always been popular since Palm/Hp and Blackberry.

Tablet PC's were out before the Apple iPad. Apple just made them mainstream. Apple copied the touch screen phone & copied the tablet. So if Apple can copy, why can't others people do EXACTLY what Apple did? Why is it good for Apple, but not good to anyone else?

umm i agree with you... Apple popularised the touch screen...but remember the iPhone is a PHONE, and phones were there before the iPhone. so technically the iPhone rode the success of the phones.
and like you said in another post... apple took the touch screen and made it better.... and now android is returning the favor by taking what the iPhone has, and making it better.... if you couldn't find anything wrong with the iPhone copying other touch screens before it, why are you annoyed at android now?
tsk tsk tsk.... *hypocrite*

Gem your right apple creates trends. Pre iPhone there was touch screen phones of course but they weren't very goof and most people used non touch screen phones. Since iPhone almost everything is touch screen. Same things can be said about app store and tablets.

OMFG!!! apple is loosing market and people in the US (their biggest market) are starting to realize that an apple product is not everything... people are moving from closed systems like apple to samsung, htc, motorola, lg and so on! i am happy that the consumers are starting to get their heads out of the apple.

people should buy stuff that feels right for them... apple, android, symbian, webos, wp7 and not last the new meego that i am sure it will be a great success.

lets all be friends, why to argue all the time...

but the sad thing is that apple wants more and more and more and more from us consumers .... ipad 2plus or 3 is just around the corner and let's be honnest the ipad 2 is just a couple of months old. the hard truth is just in front of us. pay more for less every time.

that's why i don't buy an apple product because they are never releasing a finished product... every time they offer an already used tech with a cathcy name and just ask for more money!

WHY? WHY? WHY? we can always buy better products with better features at a lower price.

you buy a 2 year contract for an iphone4 and in 2 years they will release an iphone6 with the same features as an SGS2 or HTC Sensation... dont you see that?

I'm a DROID power user. I like to get things done. You wouldn't understand. I don't need apps. I'm constantly rooting and putting in new ROMs and overclocking, which is far
more productive than anything ios can do. Apple only has fart apps anyway. No finance, word processor, graphics or social media apps are even available cause they don't hve flash and guess what? DROID DOES.

Taco some people will always go against mainstream just to be different. They will even get a lesser product because they think it cool and better on paper. The droids are paper devices the iPhones are quality devices that have real word functionalities. On paper droid is better in reality the iPhone is so far ahead of others that the other devices are forced to copy to keep up. What good is a frozen lagging device even though its 8 core and 10G

Yet no iPhone user can explain to me why my iPad keeps force closing more than any Android device I have ever had. What does iOS offer that I am missing? Maybe it's me. Can either of you tell me what makes iOS better then Android, and spare me that whole "We have more apps" argument, because I can actually see both the app store and the app market and they both have quite more then what I would ever use. Glass isn't quality material IMO, so save that one too. Stability, see statement about my iPad.

Please, help me to understand.

Ur iPad lags because of all the p o r n you watch. I had a thunderbolt all it did was force close lag and run out of battery. What good is that. iOS os better because it is easier to use and simple. Keep it simple stupid.
