Apple did not infringe on Samsung patents says ITC judge

In a preliminary ruling made on Friday,an ITC judge ruled that Apple did not infringe on Samsung patents while producing products like the Apple iPhone and the Apple iPad; Samsung had filed a claim in the middle of last year saying that Apple had infringed on four of its patents...

Or maybe it's that Samsung copied the iPhone, and when Apple sued they retaliated by suing over patents they knew Apple didn't infringe.

Exactly. Samsung need to be stopped from abusing standards essential patents. Hopefully the LTE patent fiasco they are promising to embark on will be the straw that breaks the camels back and that regulatory bodies will come down hard on them for anti-competitive practices.

Huh? Samsung is the company who are weilding standards essential patents in an attempt to block competition! That's an incredibly dangerous and anti-competitive move as it would effectively give Samsung the ability to block ALL competition from the market. If you give Samsung the green light to block Apple from using LTE you also give Samsung the green light to block everyone else from using LTE, thus eliminating all competition.

Luckily, we have anti-competitive legislation in place to prevent exactly this sort of nonsense. Samsung need to be stopped now before it goes too far.

Apple are the only ones been anti competitive and all because they know they cant compete with the latest phones. apple are a patent hoarder, patenting anything they can most of which ain't there's

I think you may want to think about this again.

Is it preferable to have products banned and removed from sale due to:

a) violating patents and designs that can be worked around


b) violating patents and designs that can't be worked around because they are the industry standard.

Allow Samsung to block manufacturers from releasing LTE devices and you have a situation where Samsung controls the entire LTE market. This is incredibly anti-competitive, although I seriously doubt we'd ever get to a situation like that since we have measures in place to stop Samsung from doing just that. But Samsung do appear to be trying their best to do just that. And for some bizarre reason you are cheering them on :/

I think it's fairly easy to understand. I'm still quite bemused why you'd be cheering on such anti-competitive behaviour though. Personally I don't want a situation where only Samsung can make LTE devices.

And Apple's anti-competitive behavior is okay? How is what Apple has done over the past two years any better than what Samsung is trying to do? They are simply fighting fire with fire; if Apple wants it all to boil down to nothing but litigation, Samsung can play that game, too.

Personally, I don't see the effect of these patent wars; no matter who sues for what, I think there will continue to be a good selection of popular products for consumers to choose from that will once again amaze and excite them: the Galaxy SIII and the iPhone 5 are good examples. I don't care for the iPhone, but there is no denying its overall impact, no matter how it got to this point.

I don't think Apple have behaved in an anti-competitive way. Sueing a company and having it's products blocked and banned over designs and ideas they could work around or pay to license isn't anti-competitive. I'm sorry but it's the Apple that started the war...

If things such as 'swipe-to-unlock' or 'rounded corners' are to be said to be innovative and protected in favor of Apple ; REAL innovative things SHALL be protected as well in favor of patent holder (in that case SAMSUNG).

I do not see Samsung threatening to sue other companies = they do coexist on a similar technological level and do understand that coexistence not being bully is a key.

Samsung is only replying to a bully Cupertino competitor that looks like apart of great marketing skills to convince people to their product is missing a lot.

Haha - you got it right, mate. Samsung's patents are as crappy as Apple's rounded rectangle patent. Those won't hold in any court. 3G/LTE core patents are owned by Qualcomm, Ericsson and Nokia because they make network equipments that are the real deals. Fanboys will tell you Samsung has this many LTE/3G patents. But those are just crappy because Samsung onlly makes phones which are mere clients of comm. network. Those are protocol related which they aren't supposed to patent in the first place. Same thing happened to the crappy 3G patent they were trying to push against Apple. They simply proposed a change to 3G protocol without telling anyone that they've already filed for a patent. This is utter dishonesty and no court will acknowledge this kind of patents.

I think the vast majority of what Samsung were sued for could either be worked around by innovating or used in their devices if they paid Apple a license fee.

Contrary to that, Apple have no choice but to pay to license LTE based patents; it's not like Apple could work around Samsung's LTE patents, because then it'd no longer be LTE! This is why Samsung has to be made to allow Apple to license this technology as opposed to preventing them from using it. If Samsung were able to prevent Apple from using LTE, they'd also be able to prevent Motorola, HTC, Nokia, etc etc. But luckily this can't happen, especially in the EU where a very dim view (and usually massive fines) are imposed on companies that attempt this nonsense.

Motorola, HTC, etc etc, are all Samsung's competitors. If you set the precedent that Samsung can ban one of it's competitors from using standards essetial patents, what on earth makes you think they wouldn't go after everyone else too? I think you're living in a very idealistic world if you think Samsung, HTC, Nokia, Motorola etc are all the very best of friends who aren't fighting tooth and nail against one another.

That's not really a coherant response to what I posted. Will Apple get what they deserve? I'm sure there's probably something out there that Apple have infringed upon that'll cost them big bucks. Will Samsung get what they deserve? Well, they sort of already have with the $1billion fine levied against them, but they are also under invetigation for abusing FRAND patents too, so there's probably more to come.

If Apple has done something wrong, they should be fairly and justly punished for it, much like if Apple hasn't done something wrong, they should be vindicated.

The exact same sentiment is true for Samsung, and every other company.

The 'glorious day' you are talking about are the days when law breakers are found guilty and punished for their misdemeanors.
