This is a pointless lawsuit, she can downgrade iOS to a more compatible one. Either she doesn't know she can or she just wants to have the lastest software or she's trying to get a free iPhone 4.

Have you tried downgrading from iOS 4.X to 3.1.3? It might be one of the most difficult things to do to a cell phone. Jailbreaking and rooting are a walk in the park compaired to downgrading iOS. It took 3 days and finally Windows Vista for me to downgrade my brothers 3G. His Mac would have nothing to do with it. Great lawsuit becasue iOS 4 runs like a turd on the 3G and Apple does NOT offer any easy way to downgrade. Instead you must hack iTunes and trick it in to downgrading the phone....great customer service Apple!

agreed, but i doubt a consumer will come out with this crazy idea if she doesn't have anything under the sleeve, so ill be expecting a surprise maybe

I was useing my Cousins iPhone3g and wow....
The speed of it is horrible! It lagged and froze up so many times i thought it was gonna reboot or lock up all together. Apple really made a mistake allowing the Iphone3g to get iOS4 the same with the itouch2g. They simply cant handle it.
