Telling Apple to wait for an appellate court to rule first on the issues, a U.S. judge has refused to issue an injunction against the Samsung GALAXY Tab 10.1 at the request of the Cupertino based firm; both firms met aqt the CEO level last month in an unsuccessful bid to settle their disputes...

Well guys a lot of you new to actually read the article before you post. Apple has a pending appeal and this judge basically said no injunction until that case is complete. Apple hasn't really lost this yet, although this is a setback for Apple.
It's also a setback for competition if Samsung gets away with it. Letting people blatantly copy will stifle innovation as there will be no incentive to invest time and money into it.

It makes perfect sense. Let's say I invest 2 years and 1 billion dollars into a new technology. My hope would be to then making that tech commercial and make money off it. If every other company is just allowed to copy my technology and make their own product there's no benefit to me for the time and money I invested.
That's why patents are important and help along innovation.

Except that there is a ton of actual evidence among the tech world, real instances of innovation, all the time. Sure, there are those who copy, but they can't *just* copy, they usually have to add their own s**t that gives people a reason to buy their stuff.
For instance, Motorola continues to innovate despite the fact that Apple shamelessly ripped off the mobile technology that Moto spent decades and millions/billions developing.

If you're talking about the lawsuit with FRAND you clearly have no understanding of what FRAND means.
What is that technology btw and since you believe Apple ripped it off don't you think Motorola has a right to defend their patents?
You guys keep saying Apple shouldn't defend their technology and innovate, but anyone in their right mind would if they spent billions of dollars developing it.
Nokia sues, Motorola sues, Microsoft sues etc etc.

The hardware was built by a bunch of other people.
The technology involved had been worked on by a bunch of other companies.
What was left for Apple to make from scratch? iOS?
Ooh, that's a big project. Rip the app launcher from Blackberry, make it work with a touchscreen, and you're done.
And the tech that Apple ripped off mostly has to do with what makes the phone part of it work. Without that, the iPhone isn't much more than an iPod touch.
Basically, the phone part of the iPhone couldn't exist without the work that Motorola put into the tech.
The same can't be said about Samsung's, Motorola's, or HTC's products.
Without the iPhone, the introduction of touchscreen dominant smartphones might have been delayed by a couple of years at most, but if they didn't do it, someone else would have.
But now you're distracting from your own idiotic argument, so let me get back on track: if the fear of copying is supposed to keep anyone from innovating, how do you explain the constant innovation STILL coming out of the mobile industry?

Wow if it's so easy why didn't you just do it? You realize Apple worked on the iPhone for 2-3 years so yes that's a huge investment and your android phone today wouldn't exist without the time and money Apple invested.
Innovation is coming out because we have patents. You take that away and bye bye innovation.

Let's see, where was I in 2007? Oh yeah, just through my first semester of college. I only had a dim awareness of cell phones. I really didn't give a crap about them then. In fact, I was only aware of the iPhone because of the fun being poked at it by cartoonists.
And it wasn't just Apple coming up with touchscreen dominant phones, even at the time. The most you can claim is that they made the concept popular before anyone else. Although, while it was popular, it wasn't a record breaker until the price was lowered to 200 dollars on contract... Which was where many of the other smartphones at the time resided. Don't believe me? Check out Steve Ballmer's (repulsive) video laughing at the iPhone.
Innovation is coming out because the key to success in any industry is making sure your product has or is something that people want and that is new. Or at least packaged in a new way. Do you think people would buy new phones if they offered nothing new or better over their old phones? Even Apple has to throw their fans a bit of a bone, and I've heard many people tell me that they won't touch the new iPhone unless it has a bigger screen at least. Yes, even iFans are getting sick of Apple's stagnation.

You still continue to use the word "copy" though the corporate CEO you favor stated "good artists copy, great artists steal.". Perhaps lectures on copying should be reserved for Apple. Also, can you explain to the rest of the class exactly what Apple has innovated? Minus the square with rounded corners, it would seem that the majority of the patents they sue over are patents they have purchased from companies that actually innovate. For example....suing for "slide to unlock"....did Apple innovate that?

You can't be this dense. In America law works off of precedents. Apple bringing up the drug shows a PRECEDENT. That's why Apple used that example.

Is the drug decision the ONLY precedent supporting Apple's prayer for 'relief'? You don't seem to understand one of the basic elements of injunction practice strategy - analogy of the present circumstance to past precedent being cited.
If the only precedent Apple's attorneys found is the drug decision, they picked a bad story to tell. Judge Koh wasn't buying that little fairy tale.

my views as innovation is different than yours.. Quad core is not available for phones in the US. and since I live in the States cannot give you that one.. smart Stay is a good one but is in beta mode. and watch how it will time out for people wearing glasses or sun glasses is not perfect yet.. HD screens not really innovation as it has been around for more than a year.. could go on. but really HTC designs is innovation to you? really. wow.. but anyhow... nothing mind blowing is in your list..

everyone copies.. except.. Samsung has gone over board with their similarities on the design of the Galaxy Tab.. why couldn't put out a brick of a tablet like Moto did.... Touch wiz.. is also similar.. not going into patents... Samsung new marketing .well they market their products well a page out of Apple playbook.. now they hold their own conferences just like Apple... if you take the blinds out you realized that Samsung sees what Apple does..
