Samsung turned the tables on Apple Tuesday, accusing the Cupertino based firm of infringing on Samsung patents; one of the patents that Samsung claims Apple illegally used lets mobile devices send pictures via email...

With one breath people accuse apple of 'silly' patents for obvious things. And with the other they congratulate Samsung for a patent that 'allows mobile devices to send out pictures via email.'

apple's silly patents are its design patents for rectangles and squares. Do me a favor, go look at the piece with the "chart" on it that show's what apple is claiming infringement on each device. Smack in the middle of the chart at the top is (i think) 669 patent.. its easy to spot. its literally a drawing of a square with a centered screen. they have a PATENT for that. Tell me how that square looks way different from every other tablet on the market. That is silly.

A patent that allows mobile devices to send pic emails is going to have to detail a specific sequence of instructions or steps in order to achieve this. Also, back when they had a patent for it, picture email was NOT common at all. Specific steps with probably a lot of programmer detail, or a rectangle.. which one is a "silly" patent?

Did you seriously try to argue that Samsungs patent for emailing pics is "silly"? The technology to send a picture through email is a far far far cry from patenting a rectangle and the color black...

Not sure where all this came from; All I said was that people accuse Apple of having 'silly' and obvious patients and that's bad. Yet Samaung have one for 'emailing photos' I mean wtf? Emailing photos? Like putting a photo... in an email.... just made me laugh that someone said 'Go sammy' and didn't comment on that.

No need for everyone to get so defensive.

You know it's easy to say "Emailing Photos is a simple patent" but when you see the dynamics of it or how it was made that's part where it kicks in and you realize it's not so plain and simple, the rectangular shape is the ridiculous patent having very very far gap from the email photo feature :)

well ...look at it this way ...samsung has some silly patents ....but they didnt go in rampage suing every one over it .... but then apple came with same or even more silly patents than samsung patents to sue all competition instead of fair competition by providing better products .
they only want thing to develop slow at the rate they want just to squeeze every penny consumer has and to do so they need to eliminate competition by using those stupid claims ..
In my view i would support samsung , HTC , Moto ,google or watever company , and i would accept them use as much "silly " patents as long it is used to counter such acts .... but NOT TO DO the same as apple .

It's not about being pro or anti anything. It's about being one sided. Samsung has the right to defend themselves in court. As stupid as Apple's patents are, so are Samsung's. But remember who starting suing who first.

the point is that everyone has picture mail now. Either other companies have found a logical work around to avoid the patent, have licensed it from Samsung, or they just didnt care enough to sue over it. Again, its not a silly patent. Its not a rectangle. Its a specific programming design. Samsung, Nokia, MS, Moto, all of them have THOUSANDS of specific little bits like this. That's the bulk of their portfolios for mobile.
Another difference between the 2 is that there are dozens of ways to send picture mail that are not exactly like Samsung's, so you can get around the patent easily. If Apple's way of sending picture messages is the same as samsung's than it IS patent infringement.
If you can find another way to have a rectangle/square with a centered screen that gets around Apple's generic patents as shown by the chart in the other article... u let me know. Samsung's patent is specific, Apple's is extraordinarily broad.

Mr. Jedii, maybe you can help me. How many lawsuits were there in the cell phone industry before Apple started them? How many lawsuits have occurred between HTC, Samsung, Motorola, and LG? Does apple copy....while suing for copying? Was Steve Jobs a deadbeat? What has apple actually INVENTED in the mobile phone industry? Does the iPhone lack true 4G, expandable storage, and BT file transfers? If yes, why? Is the iPhone inexpensive to make while apple charges premium prices? Now, can you get over the displeasure some consumers may have with a company that intentionally withholds features from consumers, markets itself as an innovator and yet invents nothing, and tries to ban products some are anticipating? People don't like apple....deal with it.

Apple needs to learn that the route of intimidation through patent litigation is not productive. A loss to Sammy on a lawsuit Apple initiated is probably the only way they will learn the lesson. When you live in an echo chamber, you start believing your own pronouncements. We haven't seen a hunger for litigation out of Oracle since they got drubbed in the Oracle v. Google litigation. Same for Apple if it loses its lawsuit against Sammy.

(notice apple doesnt have a patent on interfaces in general, just a specific design of one similar to microsoft)

I don't think most of us here are defending one particular "multi billion dollar company", as you would put it. We are defending the whole Android-eco system, that we adore and grew fond to. We just love the openness, non-restrictiveness, and non-evil type of software that Google brought to the table, and is being raided by a company that produces closed and restricted OS.

And, if you call us "loyal little doggies" (as you said on post #5) for supporting an OS that promotes openness and freedom, so be it.

Yeah, I understand that, and they buy iPhones. I got no problem with that, it's per choice. I actually bought the first original iPhone when it first came out, and it was miles ahead of everything else at the time.

But, now I've discovered Android and it really opened up my perspective.

Some people buy Android and some people buy iPhones. It's all good. But don't deprive us of making a choice by suing using ridiculous claims.

iOS is based off of Unix which is a more limited offshoot of Linux.. which is what Android is based off of. They actually share the same family tree if you go back far enough.

take out the whole part you have an issue with, and the basic is the same. This isnt about Apple vs Samsung.

This is about apple getting validation and precedence on its patents if it beats samsung. Once precedence is set, apple will go after EVERY manufacturer it deems threatening and maybe eventually after Google itself. Like I pointed out in the other reply on this thread, look at apples "infringement chart". Look at the generic shape design it got a patent for, for tablet use. That generic shape looks like 99% of all tablets on the market. If they could convince enough juries that they really somehow "own" the rectangle/square shape with a centered screen, they could shut down nearly all tablet makers.

The trial against samsung is a setting stage.. a stepping stone. If they "win" AND get 1/4th of what they are asking for, I'd be highly surprised. I bet they would be too.
However, if they win, you will see this same trial over and over and over again with different defendants.

it is really just that simple. They tried to take the space and thought they would permanently dominate like MS has done with PCs. Android pulled the rug out from under them and is developing at a continual break neck pace (hell, even im surprised at how fast new innovations keep coming). They are not winning on ideals and apps, so they are trying to take it back through litigation. Samsung is the proverbial Goliath gate keeper to the Android kingdom. Getting past Samsung with these "patents" intact opens them up to a whole world of litigation possibilities.

A near monopoly IS the final goal. You are very correct.
