Samsung intends to fight Apple's product ban request against the Galaxy S III in the US

0. phoneArena 07 Jun 2012, 09:13 posted on

Samsung plans to "demonstrate to the court that the Galaxy S III is innovative and distinctive", which it is to do before June 21, when the Galaxy S III is supposed to hit shelves on most major US carriers. This will give its sales a head start against Apple's next iPhone, whenever it launches this year, and if Cupertino succeeds with the preliminary ban, things can get ugly, considering how long these lawsuits take to be resolved...

Tell that to all the folks who preordered the SGS3 in record numbers... largest number of preorders for any single mobile phone in history... are they losing nothing? They already paid for something that they know they want, and here you are, telling them that Apple is saving their ignorant soul-less souls from buying a terrible device... no wonder they are upset. Apple may yet succeed in ripping their preordered SGS3's from their hands before they ever arrive. "Yeah, Apple just saved you from being stupid, so don't get all emotional now..." Really? Apple doing this makes me, an SGS3 preorder customer, lose nothing? Not that I am a preorder customer, but just try putting yourself in their shoes for a moment before you type out idealistic feel-good lets-all-get-along garbage...

they will still get their device so will not loose.. that's the risk of preordering.. you are ordering a device not released yet... lost of things can happen. read the fine print...

Well, unless you are referring to the illegal "black-market", I do not see how I could ever obtain something I ordered, whether before or after market release, if it can never pass through customs legally. If you are trying to tell me that there is always a way to illegally get a phone that cannot legally enter the US, if I have enough money or savvy, then that is not helpful to me, as I always much prefer to do things legally, and really refuse to do anything I know to be illegal. You appear to not understand what has been said before.

Let me put it this way... if someone, say Samsung, managed to get the iPhone 5 blocked from import into the US, then would you not be incredibly unhappy for not being able to obtain one legally because every one that you ordered (assuming you decided to order an iPhone 5) would get held up at customs indefinitely, and Apple stores could not carry them when they were supposed to be released, or ever for that matter? If you say that it wouldn't, then you are either a) lying, or b) willing to go illegal routes for things that you really want.

I really don't like the idea of anyone's stuff getting banned or blocked indefinitely, and that includes Apple products... but it is Apple and Microsoft who have resorted to (successful) bans thus far, and although it upsets me to see the clearly-biased courts favoring one team over the other, I have to accept what happens because I will not try to circumvent the legal system in order to get something I like that happens to now be illegal to obtain in the US thanks to some stupid ban.

Precisely! So many Android folks try to compare Apple to a religion or a cult...

The definition of a religion is an organization that espouses a particular set of moral beliefs, to which its adherents generally agree on and seek to comply with. A cult is simply a religion that has total adherency below 500,000, and whose set of moral beliefs are considered controversial and/or non-mainstream.

As such, Apple definitely fails to qualify as a cult... probably way more than 500,000 strict 'adherents'. However, Apple does not appear to espouse any set of moral beliefs, but instead dictates a set of technological philosophies and business practices. More accurately, the definition of a "god" applies to Apple... an entity, real or fictional, who defines a set of truths, whether morally symbolic or literal, upon which a religion or cult bases its espoused morals for adherents to follow.

Android folks are not accurate in comparing Apple with a religion or cult. It is more accurate to compare Apple to a "god" for those who "worship" it. After all, Apple has taught us many great lessons about life, such as "good artists copy... great artists steal", and "copy and/or steal with pride", and "litigate the snot out of your enemies", and "he who has the gold makes the rules", and "buying someone else's innovation is not as good as stealing it from them first", and "anyone else's innovation is yours when you are the only one legally allowed to innovate"... etc., etc.

no, Taco thinks living with his mom is considered a full time job, because his mom pays him to stay locked up in his basement and not embarrass her in public
For a real job, he would need a degree, and since he never ever came out of his basement, other than to go wait in lines, he wouldn't have gone to grade school, let alone Uni.
So, he cannot get a job, don't blame the poor iShiip, although it is his fault.

Lets stop this crap and move on to other things. All of this money these guys are waisting could be used for marketing or paying a decent dividend to stock holders.

He didn't say ban, he said stop buying. Apple wants to eliminate people's choices, so let's eliminate Apple instead. I would hate to see them go, so I would hope they would change their ways before that happens.

so let me get this straight. fandroids are against banning product because it eliminates choices. but networdumb over here. wants to prevent people to have a choice and buy Apple products.. wow sometimes I wonder if people here have a GED.. I have grammar issues but you fandroids have bigger issues.

Are we reading the same words here? He didn't say ban Apple, what he is suggesting is a boycott. A boycott isn't forced on anyone, its the exact opposite of what Apple is doing.

Why is it that when Apple want to limit our choices, iPhone fans cheer. And when Android fans say they want these devices, iPhone fans boo? If it isn't a product you would ever consider buying, why do you care what happens to it. This shows just how bad of a double standard you guy have when it comes to anything that doesn't have an Apple logo on it. You guys are alway quick to point a finger, but never self examine.

" If it isn't a product you would ever consider buying, why do you care what happens to it.".. it come from you. give it to fandroids. so they can apply it. I don't have double standard... I don't want any product banned.. like I said before. I just consume the product I don't mix what Apple does to competitors, that's why I don't get up in arms on the Android products hold at customs.. or an Apple product.. I f you want something people will find ways to get it.. if they banned Apple. I will still get my iphone without the crying..

So for the most part, you and Networkdood agree that none of these products should be banned. This is good! But how do we convience Apple that banning their competition is not the way to compete? Suing over rectangles and menu buttons is destroying the industry that many of us love and making it into a monopoly. How much more expensive would the world become if Apple does this with every industry they enter? Monopolies typically are not good for the consumer.

see that's were we disagree,,,, Apple works hard to look for the best design,,, hardware, software. screens. every detail... Jobs has been dead for almost 8 months and was working on the iphone5 before the iphone4s...the ipad took hard work because there was nothing at that time.. to have Samsung Apple main component supplier to openly take most of Apple ideas.. ( they knew the most of any other supplier) and released a very similar products.. if they feel they have the right to do it . by all means... I am a consumer not a lawyer..

I am against any company who hinders my right of choice.

Funny, just the other day, the wife and I are in Monterey and I was using her phone.
iPhoners talk about about lag and Android, and yet the iphone 4S does exhibit a little bit of ....LAG. Now, granted by RAZR is on AXIOM B21 ICS 4.0.4, and may have had the same amount of lag as the iphone 4S has, which is nominal, but I can honestly say that I was surprised by this as Taco and G-KING repeatedly tell everyone differently. My RAZR has less lag than the iphone 4S and can do more than an iphone 4S can ever dream of. Wow, you cannot even add ringtones to a non-jailbroken iphone....sad...

Dear Apple, accept the fact the other companies have been making Better and Nicer products than your overrated phone for years now! And start acting like a real competitor by doing something about your product line instead of crying like a little P&$$y who got their sucker taken away. Apple, you will NEVER be the only one, you should NOT be the only one (especially when you are clearly NOT the best in the market), no company should be the only one in any area of the market, there are laws against the type of crap you are trying to pull Apple. Your ridiculous patent crap Apple is only a proof that your company itself realizes the fact that other companies are making superior products that you can NOT fully compete with. GO F%#K yourself Apple! Always polite, BogRRR
