Samsung copied Apple says Apple expert witness

University of Pennsylvania associate professor Peter Bressler told the jury at the Apple-Samsung patent trial that Samsung copied Apple with the trade dress for its line of phones; the expert witness testfed that the Samsung Galaxy S infringes on a pair of Apple patents...

He actually said the color black?! The good news is the jury can't be that stupid to think only Apple can use black. A lot of their 'patents' are going to get tossed, but things like the scrolling overbounce will probably stick. The small amount of actual, legit patents that Apple brought will probably balance out the legitimate hardware patents that Samsung is countering with.

This is starting to look more like a draw the more I see.

Wow. I wonder where the automotive sector would be today if one OEM makes a black car with 4 wheels and a seat, only to be sued by another OEM who also makes a black car with 4 wheels and a seat. How about the wheels and seats on their own - for every wheel or seat made in the world is someone somewhere getting rich because they have some vague patent saying they own the rights to every wheel or seat ever made? I prefer Dodge trucks, but do I think Dodge should be the only truck maker? No of course not....where would the fun be in that?

Is there one toilet paper manufacturer claiming 'Royale'ties from all the other a**wipe makers?

The majority of consumers want a phone with a touch screen preferably in the middle of their devices rather than jutting out the side some where. Majority of users want their phones to be sensible in form which puts the rectangle at the top of available shapes to choose from (apple needs to follow their own advice to Samsung and make a triangle shaped iPad covered in godly stickers and see how well it sells for them).

The majority of users also want choices...something that apple is desperately trying to keep from existing and future customers. Not everyone wants to run ios on their devices, and its selfish of apple to expect this.

Oh man this trial is awesome. Samsung is going to be embarrassed world wife for their copying ways. They should have taken a deal. This is making them look horrible.

For all the android fans this guy has forgotten more about design then you'll ever learn. He's an expert witness for a reason. It's comical watching you guys bash every article that's positive for Apple.

oh, i did your homework for you. Reading the actual live feed of the trial, I found what he is an expert at..

and its not smart phones.. he's never designed a single smartphone in his life..

"Under Samsung questioning, Bressler says Apple paying him $400 an hour as an expert, and he's made $75,000 so far for his work on the case. Not a bad day at the office...."

Also, after saying that "every design element counts", he completely back tracks after Sammy lawyers ask him about the differences in the phones and the fact that US galaxy models have 4 buttons on the bottom, differences in speaker, bezel, screen size,UI look.... basically he says everything counts.. but whatever sammy brings up as as a difference

the guy is a fool.

Well got to say that ain't going to stick..This guy suppose to be a designer in that case every single detail counts to a designer... How can you say things like the size and bezel size and Button placements and speakers placements don't count when it's all part of the design... As usual some people read one article and see one point of view and they know what is going on... To the trolls please actually read multiple views... Anyone can make anything look positive when the whole story isn't being told... It's like me reading the synopsis of a book and thinking I've read the book when it's only the bare minimum.

Bressler concedes he has no direct knowledge of consumer confusion. Samsung atty hammering the point.

Bressler denies that his analysis of Samsung designs examined whether they were trying to be deceptive to consumers. Samsung stressing simple point: consumers spend a great deal of time evaluating which smartphone to buy and aren't confused, particularly when they enter into 2-year contracts with carriers.

Samsung atty walking Bressler through diagrams of so-called "prior art" that existed prior to iPhone design patents. Seems to be angling for chance to suggest to Bressler that the prior art and patents were virtually indistinguishable..Bressler quibbling already.

Well look at the s3 it has 1 button at the bottom of the screen and a voice recognition called s voice that sounds just like siri. And the interface.....Samsung mimicks apple by adding the docked applications on the main screen, they copied pinch to zoom. Everything! They basically mixed android and ios and just called it galaxy. Now let's look at the galaxy tab 10.1 they're charger looks just like the vintage apple charger we all know. Not to mention the galaxy tab resembles the iPad completely. This war is more on how the interface has certain iPhone features not so much the cosmetic shape you retarda! Get it together. When droid first came out it was so different compared to ios now android has developed the same things. Which therefore means Samsung copied them. Simple and plain. I know all u droid nerds hate apple cuz they're greed but except the facts they are the best. They're product are built with quality materials. Not plastic and cheap feeling like all the galaxy phones. IPhone screen is still untouched. No pixels! Samsung Amoled screen is b.s. bright colors with pixels for days. Just a test for u. Download temple run on the iPhone then down load it on your galaxy or any other phone for that matter and compare it to the iPhone. Then u will. See y the iPhone is the best. It's not about all the specs u idiots. What good is a 1.5 dual core processor if your apps still force close? R u kidding me? How can you honestly say android is better people? IPhones gets all the apps first too. Step it up actually play with both devices with the same apps and you will realize the iPhone is smoother. They do it best. They're the originators. And Sammy is f**ked now. Good I'm sick of they're s**tty products anyways.

You mention the central button, but of course fail to mention the extra, capacitive buttons that all Android phones have.

My Apps do not force close. None of them. Zero lag. My Galaxy S3 is a more powerful, more functional device than any Apple phone.

I think that this comment is a little biased on it's own. When was the last time that you used an android product. They are not perfect but i'm pretty sure analysts ( you know the same kind of analysts that always praise apple ) did a test and determined that ios apps crash just as much if not more than android. The difference is android tells you about it, ios just closes it. Materials vs specs is always a balancing act with when constructing a cell phone because if you want more performance you must take away from something else to keep the price points. Also your quick to forget that Samsung for a long time producers of the processors and several other hardware components inside the iPhone. That streamlined performance that you love is from a Samsung built heart not just a closed ended ecosystem. Pinch to zoom was also not apples creation those patents were out long before when the touch screen evolution was ramping up. Apple was probably one of the first to innovate and use is successfully, but it wasn't their invention to begin with. Sure they have unique aspects that grant them limited patents but that's more on how the screen interfaces with the os. That's why they aren't suing every other manufacturer for having it because they never created the multitouch concept. If you don't like Samsung then don't use them use apple, Please do some homework before coming to the game table because all your comment looks like is an ignorant hate speech. Judging the screens are apples to oranges no pun intended. They are 2 totally different technologies and usually is an opinion of the user which they feel is superior. Lol when I read that the Galaxy note "infringes" the iPad design it just cemented my thoughts on this whole thing... Seriously other than being touch orientated the 2 have nothing in common.. If Apple had won its lawsuits in the early days of the PC, we'd all still be paying $3000 for a 1GHz single core system with no GPU, and 256mb ram. Because that's how Apple rolls.

Thank god I can get a PC with good, great specs for 1/2, maybe even less than 1/2 of what some Macs cost.

If Apple has their way in the smartphone world...I would gladly go back to regular cell phones. Then again, they would worm their way into regular cellphone space....and we would be where we are today.

Did I read that right? Did this "expert" just say that Samsung infringe cause "rectangular front with the Apple iPhone along with other design features such as its transparency, black color, a display centered on the face of the phone, and a lozenge-shaped slot for the speaker." Then turn around and said "Bressler said that there were too many differences between the two patents for Samsung to make that claim." Is he not contradicting himself with those two statements?

Can the prior art not also be described in the same way he described the iphone to the samsung phones

They've had the icon in a doc formation for yrs. Apple used they're idea from there laptops and used it on their iPhone. Simple as that. They created this desighn. it's plain... not plane. you are again wrong... windows 98 had a quick launch dock. Microsoft probably holds those patents as well for launching from a secure object while in the GUI. Apple didn't introduce a launcher dock until OSx sometime in 1999 ... i could be wrong but i believe mac os docks before that time only really related to settings. Y is really why ... but I think you knew that already.

Tell ya what ftyler... for arguments to be put aside, the people will choose what they like best. Each phone has its pros and cons. I myself own a galaxy s3 my other half has the evo 4g lte (( sprints one x )) I love the feel of the HTC vs samsing hands down. The gs3 out performs the evo lte though. In smooth and speed. Its all a trade off... apple did a great job keeoing it smooth. I think both companies need to let it be to an extent and again let the people decide... you as a reasinable person has to at least see apple is really reaching... shapes and colors...I do beleive they have an excellent product but they cant revel in it forever. If they continue create a solid product that entices the people then they will be fine. They have plenty of money. I just think thay they need to raise the bar instead of suing it over the small stuff.
