CEOs from Apple and Samsung will reportedly speak to each other today, in a last-ditch effort to reach a settlement agreement before the trial goes in front of a jury...

Hope Apple and Sammy can settle this. Just not holding my breath.

Only rarely does a jury vote entirely for one party. If this goes to the jury, expect a mixed result (Apple wins some and Sammy wins some). And the damages will be mixed as well. This could be a really muddy result that neither Apple or Sammy are happy with. This is what judge Koh is stressing to Apple and Sammy - cut a deal that you control, rather than have a deal cut for you that you don't like.

Remember folks, Samsung's $14 per device is nothing like the $30-40 per device Apple wants, and yet Samsung's requested amount is "ridiculous".

Not to mention the fact that supposedly, without Samsung's technology, criphones would be an overpriced paperweight and not just an overpriced smartphone!

in my country indonesia, there's a local cellphone company named NEXIAN which stands for "Next Generation" they have an iPhone clone called Nexian Magic, the design of that phone is 90% the same as iPhone LOL, i wonder how it was going to be like if apple see this phone

They're just not seen as a threat in Apple's eyes, but if this company starts making some real traction then you can expect a lawsuit. I doubt they ever will make any real traction though.

More likely its the kind where Tim Cook looks his opponent right in the eye, and says, "Alright, in the name of peace, I'm authorized to up our offer for your 3g patents from one tenth of a penny per device to one fifth of a penny per device, if you agree to pay us $30 per device for our shapes."

Yes, they have. The working hypothesis here is that as it becomes obvious that neither side is going to win everything they want that there is more pressure to come to an agreement, as going before a jury could (and probably will) result in a ruling that neither side is particularly happy with.

So one is actually winning over the other. Neither side can stop the growth of other. All it's coming down to is compensation.
