Samsung will have pressure on it from the major carriers, at least in the States. I support their effort in protecting their intellecual property, but it will be a bit different than when apple went after Samsung for design.

Samsung will have to blink and settle for licensing. If Apple never approached them for a licensing agreement prior to making the iPhone 5, while knowing full wel they were in violation, punitive damages should also be awarded. This isn't about Apple,Samsung, or any other organization. It's about right vs. wrong and the punishment should reasonably fit the crime.

so you think apple is going to end up paying samsung instead of getting banned?

48. tedkord posted on 20 Sep 2012, 13:42

When do Apple ever pay for licensing? They just incorporate other's work and drag out negotiations. They haven't paid a penny for 3g.

They had to pay Nokia... Too bad Nokia didn't go for a sales ban plus the royalties then...

You sound just like the jurior who deceided that Samsung should be "Punished"! As much as I would love to see Apple eat some humble pie.... I just want all parties to get over themselves and make the best phone possible. But we all know that will never happen. Go Samsung!

47. tedkord posted on 20 Sep 2012, 13:40

Guys, this is fun to dream about, but let's be honest here - there'sdas much chance that an American court is going to ban the iPhone as there was of Nixon being convicted after Ford pardoned him. It's not going to happen. It should, and if there were any justice it would. But it won't.

"if there were any justice it would"

there will be....

is nice to see all the fandroids here. but sorry to break it to you.. it wont happen... I know the hate for a company blinds you guys from common sense.. it wont happen the more you guys buy into this the harder it would be to recover when Samsung again fails.

66. androiddownsouth posted on 20 Sep 2012, 18:53 2

Pot, meet kettle. No offense dude, but you are so pro Apple that you are blinded to the fact that Apple may well be in the wrong here. Your statement does nothing but paint you as a fanboy of Apple, the exact same thing you are calling the other people, just to a different company. None of the patent lawsuits are good for anyone but the lawyers involved, but Apple did start this crap. What comes around goes around. Apple got it started, they shouldn't be surprised when it comes back around on them.

67. tedkord posted on 20 Sep 2012, 20:13

Common sense, like you should be able to ban a phone for having a bas generic shape with a grid of icons?

Common sense went out the window when software patents were allowed.

56. Zero0 posted on 20 Sep 2012, 15:46 2

Ordinarily, I would say that Samsung shouldn't be exacting revenge. The problem isn't Apple, it's lawsuits.

However, in light of Apple's decision to triple Samsung's damages, I say, go for it.

68. tedkord posted on 20 Sep 2012, 20:15

Apple can't make that decision. They can ask, but they don't even end up being the full amount of the award, only a fraction. Plus, they'll end up with weakened trade dress.

62. Shino posted on 20 Sep 2012, 18:00

Hukhmm, I thing that 1 billion was just too low fine for Samsung and they are walking on a very thin ice now. Apple is already preparing to make their fine up to 3 billion. So if the asians fail again in court as they fail in copying, I think they have to give all their cash to Apple. Again. :)

64. rusticguy posted on 20 Sep 2012, 18:02

This case will drag on for years or decades before Apple can get even a dime.

69. tedkord posted on 20 Sep 2012, 20:18

Don't concern yourself with it. When it's all said and done, Apple won't be getting even the $1 billion from the original verdict. The more the jury foreman runs his mouth, the lower the award gets.

I am surprised that iphonearena has not banned them, unless you know how to hide your IP. :-)

65. DonMateo28 posted on 20 Sep 2012, 18:46

I don't think they will banned the Iphone5, b/c unfortunately that may cause sometype of economical and social meltdown lol, just sue and call it even, apple good for it lol

70. tedkord posted on 20 Sep 2012, 20:22

Apple will never call it even, because if they drop the lawsuits and stop stifling competition, they'll end up just like they did in the OS wars of the 1980' s, and they know it and fear it.

Never forget, Apple had the nerve to complain about someone stealing from them, something they stole from Xerox Parc.

These comments are so pathetic and only because Android fanatics think they'll see apple pay once... Such a shame to be leaving on this planet with all these peanut sized brains around. Maybe some other time Fandroids... !

91. yajia1 posted on 21 Sep 2012, 05:05

Look who's talking. Before yoi say "peanut brains" correct your spelling first. Its "living". Not "leaving". Unless you are to meet up with Curiosity.

90. yajia1 posted on 21 Sep 2012, 05:02

People talk as if the suing was just about the samsung phones being rectangle and rounded. A lot more components played too. Including software renderings etc. And the worst part is that Samsung even admitted to it. They needed to be punished. But i am against Apple suing Samsung and every other company here and there endlessly. One win is enough so people would know the consequences of copying and put a stop on it so everyone would be happy having different designed and implemented phones. And then now, Samsung is doing what they condone. What hypocrites. I understand that Samsung copied Apple because then, Apple was the leader of innovation. They needed to pay for that and they did. Times are different now. Apple is getting a year left behind at mobile features. Btw before anyone bashes me, and say iSheep or anything, let me say that my HTC One X and my brother's S3 are definitely better than the new iP5. Iphone5's features have been on my One X since March, and more!

92. 7thspaceman posted on 21 Sep 2012, 15:17

a lot of Apple fans waited for the Iphone 5 to come out and i bet you most of them will have it in their hands before the Samsung threat causing it to be banned if it goes that far

93. pikapowerize (banned) posted on 22 Sep 2012, 06:03

and what will it accomplish?

oh this pathetic lawsuit is getting on my nerves!
