I don't know if they can get around it, maybe they can ask Siri
(including the Siri voice-recognition program, infringe its patents)

Well, uh humm, okay maybe they can't ask Siri right now it's infringing, but I don't think they can work around all 7 patent before the launch date....hahahahhaa

We have no idea if the next iPhone infringes, and neither does Moto.

It would be great if this took the wind out of the sales for apple's upcoming presumed launch, and forced them to cancel it, as well as stopping all national sales. This could be so exciting!

I was willing to give apple a try after the maniac was fired by God. However, this idiot, Tim Cook, is carrying his torch. This will be a classic case study one day of how a top money making company imploded due to being full of rage, envy, and revenge. Just go away Apple.

Jay,

Apple started all this mess ( your device has the same shape & color as mines) so I am suing.

They try to act like Microsoft (bullying Android Manuf) and try to fleece companies for money

Now that it's time for MS and Apple to put up or shut up (court-time); they have a problem with Moto/Google usinf it's 17,000 plus patents to have their product ban.

Trust, anyone who loves Cellphone technologies (no matter who it is from), never ever want anything ban or bully; may the best company win.

Apple and Microsoft came in with some childish bullsh*t behavior, and they are getting their a$$ kick right about now, and this is the reason EVERYONE is happy...MS and Apple brought this on themself!.

I say," Moto should seek a ban on all of apple products and Microsoft's xbox 360 & 720".

Microsoft's patents are actually somewhat legit. Still kinda bullying, but not much. (Plus, I like Microsoft.) Apple's "patents" aren't legitimate in any sense.

Other than that, I agree with you.

Apple asks to ban products and refuses to accept money. Motorola asks for money and wins the case but apple refuses to pay. Motorola is forced to ban apple refuses to accept anything but a ban. That is why apple rarely wins in court but moto has a chance.

Nothing hypocritical about it. I don't want Moto to get Apple's products banned. I want them to have the leverage through these patents to once and for all force Apple to stop with the foolishness.

Though, it's also not hypocritical to get a little satisfaction from someone reaping what he's sown. I mean, I'm generally against a third world dictator killing his citizens, but I don't cry when his citizens revolt and kill him.

as much as i think it's ridiculous for all of this to go down at all, whether it's Apple or Google as aggressor...

at this point i feel like Apple is Japan (please don't consider this racist lol) and Google is America. Pearl Harbor has been bombed. and in order to stop the war Hiroshima and/or Nagasaki need to feel the wrath.

metaphorically of course... i just feel sad that Google has to stoop to this level but at the same time i don't think Apple will learn unless they are thoroughly punished.

I don't want to see any products banned. For consumers, us, its never a good thing. I wish some of these fools would stop with their favorite sport team for the win fanboy nonsense and realize that we should embrace competition. We always win with competition whether it is Apple making a better device or another company. We win with better products at lower prices. What's fair for one company to sue over is fair for another. Samsung, Motorola, Google, etc aren't suing and trying to ban Apple products out of fear of losing money. They are trying to send a message to Apple that the bullying needs to stop and they will fight back.

Its funny you mentioned sports...

The best games are the competitive ones, not the blow outs. IMO.

I agree....competition is a good thing.

This trial isn't the Superbowl and its Apple vs Samsung for the big game! This is about banning products and decreasing competition over the dumbest patents to be granted. Apple deserves to lose and be sued but only because I hope it'll teach them a lesson and they stop with this ridiculous crap. Bring better products to us.

Sad part is, no end is in site. Don't care how Apple/Samsung ends up, there seems to be plenty of ammo left in everyone's arsenal.

imo, all these suing needs to stop. whether it is Apple suing Samsung or Moto suing Apple or vice versa. this has to stop. it is getting out of hand. honestly! Apple might have started this stupid trend, but this is seriously hurting the consumer the most. if one company wins, the other gets banned. but the one that wins would have wasted so much money on the lawsuit, the win isn't really that much of a win financially. plus, all this suing means less innovating. we are going to lesser choices of phones, and no more innovative phones! all of them will take e easy way out of copying, patenting the copied thing, and sue the rest to abolish the competition. can't we all just live in peace?

Suing doesn't hurt innovation. R&D is completely separate from legal. And pricing is hammered out between manufacturer and carrier long before these phones see the light of day. Phones have tier pricing based on the presumed quality of the device. So say in the future Samsung releases an entry level phone, well that's going to be pegged between free and maybe $30. Whereas a top tier phone gets auto launched at $199.

So I say sue your happy little nuts off. It's not going to hurt me one bit. You think your IP deserves protection? Get me out of work for a couple of weeks on jury duty so I can laugh at your lawyers and vote for your patent for rectangles to be revoked. All you did was waste my time, waste your time, and make AT&T pay me for not going to work.

yes, but they have to be careful on their innovations bcos of vague patents! and if the lawsuit gets out of hand, and drags on forever, the fees will accumulate and they might even have to take money from other divisions if their legal budget has been crossed.

Ohkay, it may be karma, but I hope Motorola and Google don't turn into Apple in the process, targetting other OEM's for troll-patent infringement in the long run.

This is part of the reason why Google bought Motorola. Moto had hinted at lawsuits against other manufactures. A few days later....news about Google buying them was announced.

Only time will tell how worse these companies can be. Competing in courts instead of market? That was not why smartphones were made!

google is using motorola to hit iphone just in case samsung lost in their court battle so thye could keep apple busy and maybe force them to settle with both samsung and motorola and google as a whole. if this fail, maybe they will encourage lg to sue iphone also.

People who want Motorola not to sue Apple, this is probably the third or fourth time Motorola has attempted to negotiate with Apple on a patent license agreement. Apple has turned down every single offer but still uses Motorola's technologies in their phones and not just FRAND patents which Apple isn't paying either. These are 7 non-frand patents, meaning they aren't subject to across the board licensing deals. Apple simply refuses to play ball with any manufacturer that they use patents of. It is ridiculous. Now Motorola has no choice but to sue. They have attempted the good faith bargaining, it failed, a judge already ruled against Apple on other patent infringement -- Apple simply refused to settle out of court.

Apple seems to think their brand name makes them invincible and that they should simply be allowed to use whatever patents from whatever company free of charge while attempting to extort other companies for creating a black rectangle. Something has to give, and if Apple refuses to play nice, this is the only way to make it happen.

I can foresee Apple coming out against the entire patent system as soon as they start losing cases. "The patent system isn't fair, it favors the individual and allows them to extort larger companies!"

Apple is attempting to become this generations version of Microsoft. Except they want to have a smartphone monopoly.

2 APPLE employees at lunch having a nice conversation:

Employee A: Hey, B, ummm, I notice the blueprints for the next iteration of 'the phone'
Employee B: Yeah?
Employee A: Well, umm, they look nice and all....but....
Employee B: But, what? I worked hard on them for about 20 minutes, copying them from the last blueprint.
Employee A: So, that is it - looks like like a flatter version of the last phone. So, now what?
Employee B: Tim wants me to take a bar exam in the morning. I am need on the front lines. Says he is closing down the innovation shop.

It's not so much fun when it's Apple who's on the receiving end of litigation, huh?

Seriously, I'm not a fan of all these lawsuits and injunctions/bans/etc., because as we've seen with Apple vs. Samsung, either company (or in this case, both companies) will never be looked at the same way again. Samsung, despite being the knight in shining armor in the eyes of many, is not invulnerable to criticism regarding their actions and ideas in their suit...and Apple is not invulnerable, either.

This really does seem to be karma coming back to kick Apple right in the ass, a taste of their own medicine, if you will. Whether they win or lose, Motorola is letting Apple know that they can take others to court for silly patent claims, too.
