I'm a little torn on the trackball thing. I think it was a great idea to implement on cell phones, but it is probably the largest culprit of "butt dialing" in Blackberry devices. I have a Pearl for work and I had to cut a hole out of my carry case just so the trackball isn't doing it's on thing in its case and calling Timbuktu and changing critical settings. I don't know how they are on Android devices as I only played with my friend's G1 a little bit and never asked him about it's trackball pro's and con's. Hopefully the trackpad works just as well without the "butt dialing" issues.

Isn't the HTC Legend supposed to be the Hero's successor? Earlier rumours stated that the display is 3.2-inches or something - especially since you stated that it's "smaller than the Hero".
