Microsoft adds Google to law suit against Motorola in Germany

0. phoneArena 13 Oct 2012, 23:05 posted on

On Friday, Microsoft said that it would be adding Google as a defendant in a current patent infringement case it filed against Motorola; Microsoft says that it is adding Motorola's parent company because the suit revolves around data that Motorola says has to do with Google...

Can't say Microsoft did a bright move by adding Google's name to the lawsuit, but since they own MM, their in it by default. lol

It is more a matter of having Google become subject to decisions made by the court. MM stated that materials demanded by MS are in possession of Google, and not MM. The only way MS can compel Google to produce the demanded materials is to add Google to the lawsuit. If Google is successful at avoiding being added to the lawsuit, then MS is basically SOL on getting access to the materials it wants.

It's all because of Apple! Had they not started suing everyone in the world - Microsoft wouldn't have dared to sue Motorola and Google.

Could you shed some light on that claim. The earliest I found of google & microsoft in a patent dispute was from 2010, which was actually micorosft going after android oems. Not saying you're wrong, but I just spent an hour & came up with nothing.

Reference your arguments points or it may as well be a false statement

+ 3 on what patent of MS is Google infringing? I didn't down-vote you, but I am interested to know which MS patent Google is infringing, much less paying MS a royalty on.

Instead of pulling an Apple.. maybe MicroTrash should start using its resources to learn how to make their own damn phones!

The Xbox 360 & 720 violates four Motorola patents.

Sound like Sony PS3 is going to overtake MS gaming system :)

Precisely.

It takes more than a genius to come up with the not-at-all-obvious concept of "combining data sets." Google should have thought to check the patent records before doing something so inherently innovative. They deserve more than just a heavy fine.

Why is every company intent on suing the only company which is actually progressing in terms of technology?
Patents have only one use- stop development and make money.

Reason is the newer upstart is like a tidal wave of youth and ingenuity that just keeps making things better and aren't stick in the muds. Innovation isn't supposed to be stifled, just look at Apple these guys don't like to lease anything for fear of someone else making their tech better and much more efficient than they do. Cowards. MS just wants to take money because their platform is in the dumps because they decided to release oh so many years ago some half baked OS for mobile phones which could barely do a damn thing but let you use the phone, everything else was horribly gimped(windows Mobile, I'm talking 7 years ago). Data overlay on a map, Ms doesn't even have mapping solutions, this should be looked at as patent trolling, as MS doesn't even use this tech.

MS Street and Trips.

MS had it with one of my first laptops, you needed a gps receiver, but point being microsft had mapping programs in past you had to pay for. I will say that thanks to google, mapquest and others, free online maps became the norm, but fact remains to answer your questions, they did and do have mapping solutions.

This info coming to light is strange.

I asked this the other day....Why would HTC, Samsung and others pay MS for Google Maps infringing on patents...when thats a Google product? I dont think any manufacture altered Google Maps.....so this shoulda been directed at Google from day one.

What am I missing?

I also said this....its about time what MS has been getting money for has come to light. I have wondered about this for months.

HTC and Sammy are the ones who are actually selling phones with the infringing functionality. Same logic applies to Apple v. Samsung.

I have been racking my brain thinking of a reply....lol. help me out....

That explains why in Apple vs Samsung...some stock Android icons were included and they went after the G Nex? If so that make it more clearer to me. Part of whats causing me confusion....is Oracle didnt go after the OEMs, they went straight for Google.

So....should Oracle have gone after HTC, Samsung, etc? I didnt go back and look at the all past lawsuits......its too many to keep track of. One suit I remember is Paul Allen mentioning Apple, Google and others in a lawsuit for their OS's. I dont think its directed at any phone or PC manufactures.

Something else came to mind thinking of this reply....wonder if Apple knew about this and thats part of the reason for dumping Google Maps. Apple probably already have a licensing deal in place with MS....lol. Which would be wild...

My guess is that since google operates in the realm of an open platform, with no actual license fees being paid, that any infringment most falls on the manufacturer, as once they edit the operating system in any way it becomes theirs. That woud be my guess.

In Samsung Vs Apple case in US court, Court had wanted explicit details of all licensing/cross licensing deals between samsung and M$ to be placed on table and both M$ and IBM were running to court desperately trying to stop that. This whole patent office is a SCAM. American patent system has become a joke where guess if M$ or Apple files a patent for how to walk to loo they wil be grabnted one. Ridiculous. They gransted Patent/Trademark for "BASMATI" to some company and i am sure these intelligent lot knew basmati is a rice originationg from Indian Subcontinent. They had to annul when ther was a huge protest.

PATENT system is for corporations to RIP Off a customer and avoid entry of new business into market.

Yes American patent office wanted to kill that by favouring Texas based US company Rice-Tec with the favor so that they can mint money by stealing what has been famous for decades. No one can say USPTO is manned by so illiterate staff that they don't know what basmati is all about. It just shows the evil and corrupt intent ... "I will rob you but if you try even to think of doing it you will be chased to every cornmer of world. That's what both M$ and Apple are doing" sadly ... Ideally all applications for patents should be open for challenge before patent is awarded.
