Half the people watching television ad confused the Samsung GALAXY Tab for the Apple iPad

Internal Samsung documents revealed in court on Wednesday, showed that those watching television commercials for the Samsung GALAXY Tab thought that the ad was for the Apple iPad; only 16% of those viewing the spot correctly knew that the device was a Samsung product...

Compared to the third gen iPad? Of course! Remember, this was created as a competitor against the ORIGINAL iPad.
I can easily say that this is better in many respects than the OG iPad, but compared to newer models, the Apple product is better.

It is unfortunate that by "having a case", their marketing department can say, "woot, we did such a good job, competitors are helping us advertise!" only to get smacked by the lawyers and get told to, "stfu". It's times like these which raise pressing questions like which profession would land you in a lower level of Hell. And wonder why Apple would sue them, of course.

Well Samsung Galaxy Tab advertisements appear pretty much everywhere like Tv commercials, billboards, and ads on webpages and web videos. Pretty much everyone is exposed to these advertisements.

Most tablets look very similar to each other by their very nature. This isn't just Samsung copying Apple. People only get the Samsung Galaxy Tab and the iPad confused because the iPad has become so synonymous with the entire tablet industry. When people see a tablet, they assume at first sight that it is an iPad. If Apple can sue Samsung for making a similar-looking tablet, then Kleenex might as well sue anyone else that makes tissues, and Post-It might as well sue anyone else that makes sticky notes. You can't tell the difference between a Kleenex tissue and a tissue from another brand.

With the way technology is going these days, 20 years is beyond reasonable as a timeframe. How long has the laptop been around and how many OEM's made them? (was there any pathetic laptop wars/trials?

Until very recently, Microsoft was mainly a software company. Now that they are producing their own branded hardware Asus is pissed. Sound familiar?

laptops/computers are in no way, shape, or form commodities, they're far from it actually. I think you're a little confused.

And aside from Samsung's design, most of Apple's suits have to do with software. It's kind of hard to have a laptop war/trials when most laptops are running the exact same software.

cityeighteen is right. I have a Tablet S, which looks nothing like the iPad (which Apple lawyers even specifically called out as an alternative design). I get a lot of people going "Hey, nice iPad". It's not about the design, it's that due to Apple marketing, dumb people automatically associate a tablet with the iPad, no matter the design. And there are a lot of dumb people...

Sammy is eating his own dessert... There are huge differences between those 2 devices but Sammy is taking the same path as Apple just by showing the same things that the Apple iPad. Personally i want Apple to lose this case and Sammy to avoid all the similarities with Apple products. Just look at the SG S3!!! They were able to show a brand-new device and the person who cant tell the differences between an Apple iPhone and a Galaxy S3 is because he is not living in this world...
