According to Microsoft Motorola Mobility "has refused to make its patents available at anything remotely close to a reasonable price." The squeeze on Motorola's side comes about essential 2G and 3G patents for the iPhone and iPad, whereas Microsoft is allegedly being extorted for H.264 video codec licenses...

Being a bully isn't against any rules or laws. The same cannot be said about using FRAND patents as a weapon.
If you burn down a bully's house, you're still going to get arrested for arson.

How many patents do Apple have as FRAND? That may be the bigger question....expecially for them trying to sue Motorola for the Xoom cuz its shaped like a rectangle and has round corners.
Suing over software is one thing...and even with them vs. Samsung...that was questionable IMO. Wont even go into the hardware between the iPhone and Samsung...the iPhone has very distinct hardware buttons....not talking about the home button.
They basically sued Samsung over how the front of the phone looks, some icons here n there and the Samsung app drawer. They had to sue Moto over the black borders of the Xoom...cuz thats about all I can see that even comes close to resembling an iPad.

Live by the sword, die by the sword. I am sooooo broken up that Apple and MS are complaining about 'Tony Soprano' tactics. As if they don't do the same thing to Google and Android partners every chance they get.

Now if I am reading this right, and it is only one side of the story, Microsoft is trying to pay for the right to use the patent. The really disturbing part of this is Moto is the only one of the major players to use Android to not have an agreement with MS. I know the rumor is MS has approached Moto about licensing the patents that Android uses. Regardless of peoples feelings on MS, they have kept this out of the courts. If Moto is playing hardball on licensing it's patents to MS, I am betting they are going to fight on paying MS on theirs. I am so not looking forward to more litigation. It bores me.
It is Motorola's right, but..... really now. Just take money, pay a little back, and lets move on. Apple VS the world is enough.

No my view doesn't change. I don't bash Motorola or Samsung or any other company that has sued Apple. Being a reasonable adult I understand this is how business works. Apple had a right to defend its IP and maximize profits and so does Motorola.
It's your view that changes. When Apple uses Foxconn they're evil and have blood on their hands. When Microsoft, Dell, Amazon etc use Foxconn its no big deal.
Did you know Motorola sued Apple first before Apple ever sued them? I bet you didn't and I bet it doesn't matter to you. You're not interested in any facts that don't support your Pre defined views.

We have been over this, Taco. Motorola only sued after two years of unsuccessfully trying to get Apple to pay royalties on the tech that Motorola developed. Apple sued them right after and then went after every other major Android manufacturer. If Apple were paying its fair share of royalties to the true innovators in the market, if they weren't suing over ridiculous concepts they weren't even the first to develop, AND if their goal wasn't to wage THERMONUCLEAR WAR on Android simply because Android looks a little bit like iOS (and much more like brew and blackberry os) I wouldn't have a problem with it.
Hell, you didn't see me complain about Apple going back to the negotiation table with Samsung to hammer out a cross licensing deal, did you?

Apple, just like any other company, will try to minimize royalty fees. If they can get away with not paying them they will.
Android copied a lot from iOS. The whole basics of the OS are a copy. That's the funny thing about android supporters. You guys love android, which took so much from iOS, and claim to hate iOS. If it wasn't for Apple and Steve Jobs you'd still be using your trackpads and qwerty keyboards and browsing the web on a WAP browser.

Why do you assume that without the iPhone smartphone innovation would have remained stagnant? The industry was already moving toward touchscreens and thinner, more elegant devices. In fact, the Motorola Q was the thinnest smartphone in the world until the iPhone 4 came out. Blackberries were seen as meant more for business people, as were Palm and Windows Mobile devices. How arrogant to assume that nobody else would release a touchscreen dominant device ever if the iPhone didn't exist.
And apart from the touchscreen and app store (another concept already coming into its own by the time Apple appropriated it) what else did Android actually copy from IOS? If you say "rows of icons," I will cut you.

Not saying it would have never happened, but Apple leap frogged the competition with the original iPhone. If you're an android lover you should give credit to Apple for a lot of the things you enjoy on your OS. Apple pioneered those things.

Yes, Apple did leapfrog the competition in providing a touchscreen dominant, user friendly phone that eventually morphed into a true smartphone.
However, you didn't answer my question: apart from the touchscreen dominance and independent app store (both of which are debatable anyway) what other specific cues did Android take from the iPhone?

They are not what I woudl call pioneers in the smartphone world.
A pioneer for phones would be LG, Motorola, Palm, Blackberry.
In the PC world you may can call them that....but you better also call Xerox pioneers too.

I'm guessing Apple and Microsoft both forgot that the "R" part of FRAND stands for reasonable. I consider it very reasonable that these patents hold a lot more value than say, a rectangular appearance, since they actually facilitate a functioning device.
So, that leaves us with the "F", for fair. If Motorola is offering a similar deal to everyone else then yes, it is indeed fair as well.
It's up to how well the lawyers argue now though.
