Apple's motion for an European ban on the Samsung Galaxy Tab 10.1 leaks with comparative design drawings

0. phoneArena 10 Aug 2011, 05:54 posted on

The whole injunction against Samsung for violating Apple's intellectual property in design patents with its Galaxy Tab 10.1 has leaked now, and Apple is apparently using design drawings of the iPad 2, in order to demonstrate the alleged similarities...

Of course, Apple would probably hate it if the iPad were shown alongside some of the old Microsoft tablets from almost ten years ago.

Other companies: you violated our patents! We would like some monetary compensation for the use of our IP.

Apple: You violated our patents! And your product is possibly going to be very popular! So we absolutely demand that you never be allowed to sell at all ever in a million years!!!!

That's nonsense. Apple made the tablet market we have today. Samsung is obviously copying Apple's design. Their phones and tablet have the same look, same colors and similar UI design. Remember when the iPad 2 came out and Samsung said we need to be more competitive. Then they made their tablet look more like the iPad 2.

There's no lawsuit against plenty of tablet makers that are not trying to trick people into thinking their tablet is an Apple product.

Remember when the iPad 2 came out and majority of the device was manufactured by Samsung then Apple decided to tell Samsung to go f**k themselves by suing their asses, trying to ban their products all over the world, and saying how LG will be their main manufacturer?
Yeah.... about that, Apple is crying back to Samsung now because LG is unable to meet their demands.

If Samsung declines, Apple will probably sue Samsung for infringing on Apple displays, made by Samsung.
If Samsung accepts, Apple will probably sue Samsung for infringing on Apple displays, made by Samsung.

You're not even on topic, but there's plenty of screen manufacturers. Apple can do just fine without Samsung.

then why did they ''run'' back to apple and not any other company when lg were making rubbish screens for the ipad2 and i know this has nothing to do with this article.

No, you're not on topic. My post is clearly countering your ignorant post.

I'm commenting on the article which is about Samsung being banned from selling their tablet. Your response is:

"Remember when the iPad 2 came out and majority of the device was manufactured by Samsung then Apple decided to tell Samsung to go f**k themselves by suing their asses, trying to ban their products all over the world, and saying how LG will be their main manufacturer?
Yeah.... about that, Apple is crying back to Samsung now because LG is unable to meet their demands. "

That's not the same topic. You didn't mention anything about this lawsuite.

Because the lawsuit happened, which is considered in the past. Because of the lawsuit, Apple went to LG as it's leading manufacturer. Now in the present, Apple is crying back to Samsung. This is cause and effect. It was pretty common knowledge.

And yet the courts agree with Apple and have banned the samsung tablet. So all the trolls here think it's unfair while an educated court feels that samsung IS copying. Why is that? According to you guys Apple should sit back and let people steal from them.

This is promising. Now I'm thinking there's a good chance of a ban of samsung and htc in the US.

hahaha, just because som court system in the EU is corrupted does not mean Samsung is copying apple.
Apple is going to pay for this when Samsung sues them and apple has to pay costs and damages to samsung

We will see. So far samsung has been banned in all of EU and Australia. If this was a joke like you android fanatics say the case would be thrown out.

Mr Taco, im not an fandroid.
I am a fan of bada and MeeGo not Android.
But i do think that this is very unfair to Samsung and very foul play by Apple.

if you read the whole story samsung were not even given a notice or even a chance to defend themself and the only reason that apple were able to get this ban in that manner is if samsung get the decision overturned then apple will have to pay damages to samsung.

As usual, reading comprehension is beyond your grasp, Taco. The ban is not a final decision, it's a preliminary measure until it's determined whether Samsung is really infringing. If the decision goes in Samsung's favor, Apple will have to pay Samsung reparations.

The same goes for Australia too.

Granted, Apple has a lot of cash, but should this go badly for them, they'll have to pay two continents' worth of compensation for Samsung's lost sales.

your right, taco50 can't read or write or think for himself
But think of this, in a courtroom sometimes the lawyer will say something that is stricken from the record or overruled, but you can't put the cork back in the bottle, even if this thing is thrown out, Apple has spread their venom and more sheep to their flock.

I understand the article very well. My point stands. If this was so frivolous why are the courts agreeing with Apple?

They arent agreeing with apple. They granted a temporary injunction until a decision can be made.

If apple wins, then the injunction is permanent. If apple loses then apple has to pay samsung for ALL the lost sales that they expected from the Tab.

An injunction is in no way a final decision.

And if apple's case is so strong why are they using drawings with little detail in them instead of the actual product? Why? because when you draw a tablet, they all look about the same.. But only and iDiot would not be able to tell the difference by actually seeing both tablets. They are playing dirty pool. Im glad you like bullies cheaters, that says a lot about you.

So the courts grant injunctions for no reason then?

Because, Taco, that's how courts work: if there's even a possibility that a company's products are infringing on patents, it would be useless to keep allowing them to sell during the months it takes to close the case.

As Remixfa said, this is not an act of agreement with Apple. I'm thinking maybe we need to pool our resources and send you back to school so you aren't so goddamned ignorant,
