Apple's European filing against Samsung mentions similar complaint filed against the Motorola Xoom

Not to be satisfied until all Android tablets are barred from every store on Earth, Apple has seemingly also filed a complaint in Germany against the Motorola Xoom although the details of the complaint are not readily apparent...

First off, Nokia had phones that looked similar to the original iPhone in European and Asain markets, they sued Apple over IP violations not similar phone appearance. Motorola is not saying you can't make a product that looks like mine, just don't use our IP and not pay us for it.

Depends.... These are mostly all the same patents they brought against HTC... because all these devices are using android.

Odd that they are not going after google who actually develops the OS they have issues with.

They probably don't want to go against a bigger company... they would rather bully.

The Xoom?! Really?! This is enough to make me go back to Windows. I've been an advocate for Mac computers for some time now, but BS like this is just turning me completely off of anything Apple. I get sick of seeing the phrase "Apple is suing..." over, and over, and over, and over, and over, and over, and over again! They're starting to look like a bunch of pussies (excuse my French everyone)! I don't care if they successfully ban every other smartphone on the planet, I will never dirty my hands with an iPhone 5, 6, 7 or whatever the hell they're calling the next big thing. If they grow a pair and compete like men, I would reconsider my position. Until then, f**k you Apple like Jason Biggs!

Well they're definitely not suing because the Xoom is selling well I can tell you that. Personally I think the Xoom looks different enough unlike the Galaxy tab. However it's for the courts to decide. I don't think Apple would take this to court if they didn't think they had a solid case.

Apple is desperate? Really?! Lol. This you see that they're now the number 1 company in the world by stock? I wouldn't call that desperate.

Try being a little objective.

Are you referring to the kid that had the white phone conversion kit? Didn't Apple win the case and then dismiss it seeking no money? Don't you think something like that can affect Apple's bottom line on a larger scale?

Why are you upset at Apple for countersuing Motorola?

Why aren't you outraged Nokia sued Apple?

Oh, this kid with 200a kits was going to bring down Apple by sell these kits online? Even if he sold those kits for a grand a piece, that wouldn't have hurt Apple's $76 Billion dollar bottom line.

And I am not mad about Apple suing Motorola. I'm discusseded that Apple is trying to ban EVERY cellular and tablet manufacture that uses Android. Apple looks weak, they look like cowards, pussies...afraid to compete with Android. They haven't tried to ban anything from RIM, HP, Nokia, or even any WP7 products made by HTC or Samsung. Why only Android products? The answer seems to be that Apple is terrified of anything Android. Even with the best selling phone in the world, Android just keeps kicking Apple's ass in marketshare. Personally, I dont care if Android is first or last. I just want to have a choice, but Apple wants to limit MY choice because they just can't a phone worth buying. At least IMHO.

Taco, they are saying these devices look like the ipad. Use your eyes and your common sense here for just a second. Does the Xoom look anything like the ipad to you? Does this 10.1 inch, all black, widget based tablet look anything like the iPad? Would you confuse one for the other? No, you wouldn't.

Apple just thought a year later that the Xoom looks to much like the ipad? I don't think so. Apple looks like a bunch of pussies right now, and your cheerleading for them will not change anybodies view. They are making themselves look desperate because Android is whoopin' that ass! If they were trying to protect their IP so bad, why not sue the other OS's that allow you to tap on a number to call it? That's what one of the patents was for, but they aren't suing the makers of any other OS that have that functionality. Why? Because they are not the immediate threat. Android is!

Okay. I'm wrong. But upon reviewing the statements made by Motorola, they only opted to sue over those 18 patents when Apple completely refused to pay licensing fees for any of them.

Nah. At the time Apple wasn't taking away from their sales; Motorola was doing better than it ever had before, its market share was high, and it had some hit phones on the market. And it had tried to negotiate with Apple over getting royalties, but Apple wouldn't play ball.

Now however Apple is suing Motorola because the XOOM looks vaguely like the iPad...and every other tablet in history.

i don't know why Motorola sued Apple nor do i care. if it was a big deal we would've known it by now but Apple is suing everybody and their mom and the scary thing is they could keep on until some products get banned. the Galaxy S II launch in the US could be delayed some more. it's utter bulls**t.

If the track record of litigation of the two companies were reversed I would show more sympathy toward Apple. Furthermore, Motorola sued over 18 solid patents. What's Apple suing over right now? The looks of the XOOM.

You know what the difference is between us sniggly. When I'm trolling I know I'm trolling. You actually believe you're making valid statements. You just did a total 180 here.

1. You just assumed Apple sued first and said Motorola was justified because they were only retaliating.

2. When proven wrong you backpedal and say that Motorola's lawsuits are over "solid patents". How do you know the patents are solid? Are you an expert in this area? How come you don't consider Apple's patents solid and their lawsuit against HTC justified?

3. You try to turn this around on Apple as if they're being hypocritical for fighting back against Motorola's lawsuit while Motorola, HTC among others are doing the same to Apple.

Face it you're blinded by hatred of Apple. There's nothing good Apple can do in your eyes. You wait and hope for bad news or for them to fail every day. Somehow in your head though you think you're objective and make good points.

They sued in 2010 when Apple sales were in FULL swing! It's not like they sued in 2007 when the iPhone just came out. You see how unreasonable you are?!

I usually am objective and usually do make good points.

My question to you is: do you think Moto's lawsuit against Apple is justified?

Let's look at some facts here:

HTC willingly pays royalties to Microsoft, without Microsoft ever having to pay a lawsuit.

HTC hasn't paid royalties to Apple, and the only two patents Apple supposedly has against HTC which are still being considered are absurdly broad in their language.

Apple only paid a lump sum of royalties to Nokia after being sued and losing.

There is no record of Apple paying royalties to anyone else.

Motorola only sued after, they said, Apple refused to agree to pay any royalties whatsoever.

The most current lawsuit Apple has toward Motorola is over the general appearance of the XOOM, not technical patents.

I was wrong about the original order of lawsuits between Motorola and Apple. I admitted it. My overal position about the issue of Apple's lawsuits didn't change: they're more than happy to sue everyone and their brother for making products similar to theirs, but they have no problem stealing from others.

So to sum up what I'm saying:

Apple is suing anyone and everyone who occupies the same market as they do. They have a track record of this.

Motorola does not have a similar history. They haven't yet sued over issues of general appearance.

Motorola's original lawsuit covered "wireless communication technologies, such as WCDMA (3G), GPRS, 802.11 and antenna design, and key smartphone technologies including wireless email, proximity sensing, software application management, location-based services and multi-device synchronization."

These are all fields of technology Motorola was obviously involved in way before Apple entered the playing field.

So yes, I think Moto's patents are valid. So Apple refusing to pay on these while suing everyone else on their own patents is extemely hypocrtiical.

Yep! Number one company, with number one phone and they are still petrified of Android! With all their success, they're still number 2 in marketshare. They won't stop suing and banning until they're number one. And if WP7 ever makes it there as they say they will in 2085 or whatever, Apple will sue them too. Because they're cowards. I said that I don't think the Xoom looks a whole lot like the iPad personally. However you still have a double standard with saying Apple's IP isn't legit because it's too broad and Motorola's is solid. That's for the courts to decide. Everybody sues everybody. Apple just gets more publicity so we hear about it.

Apple has to deal with lawsuits all the time.

Actually, all of the lawsuits are pretty well documented. And my point isn't so much whether Apple has legit IP as it is about Apple's position on whether other people get to implement their IP (which is NEVAR!) versus how quick they are to take others' IP and never pay a cent for it.
