good post good to see someone being reasonable about Samsung's copying. They did do this to themselves because they were definitely trying to mimic the look and feel of the iPhone.

Really? What do you think they won? All that they are winning at is losing respect from more and more iusers, which is why more and more people are dumping that little idevice :-)

The title of the article is below. Are you having a hard time reading? They won the case because the court agreed that Samsung is copying Apple.

Of course fandroids spin this into somehow being a win for Samsung and supposedly there is no copying happening. How is it that Apple keeps winning these cases then?

"Apple wins case against Samsung in the Netherlands; Galaxy S, SII and Ace will be sold there no more"

yes they ''won'' but considering that what the patent infingement that they win can easily be changed by samsung which would allow the galaxy devices to still be sold so they have not really gained anything from this..also what this article fails to say is that apple failed with the look and feel of the device which apple were really gunning for..so the fact that samsung can get around this, how is this a significant win for apple

THIS report is sensationalism brought apon by an initial read of what was going on at the court. Every other site that actually updated the story as it went along changed the story tremendously. This article on PA is so wrong its not funny. If you havent noticed, most of us have read other sources today and actually read what went on, not basing our iOpinions on this dated PA article.

Apple didnt win... well not in the way that u keep trying to think they won. And its not really a win, its a gotcha that samsung has plenty of time to fix. Its a simple change to a line of code.
And the judge said once its fixed apple can never bring up that patent again in that country.

Maybe its the fact that Samsung was getting sued for icons and hardware too, remember?

The LG Prada came up in court...out went the hardware part. Icons...the judge probably just laughed.

All they got called out on was 3 patents that looks to be only 1 now. And that can be fixed with an update. This was a waste of time.

I agree that the first icrap had a lot of affect on mobile industry but in my opinion if there weren't any other smartphones except iphones, then the iPhones wouldn't also make so much improvement generation by generation. My point is that its competition that makes progress, so apple fanboys also shouldn't be so happy of this kind of sueings going on and on

A patent is a set of exclusive rights granted by a state (national government) to an inventor or their assignee for a limited period of time in exchange for the public disclosure of an invention.

The procedure for granting patents, the requirements placed on the patentee, and the extent of the exclusive rights vary widely between countries according to national laws and international agreements. Typically, however, a patent application must include one or more claims defining the invention which must be new, non-obvious, and useful or industrially applicable

ps.. and no Mc Donalds cannot sued becuase other people used round meat...

I hope this would teach Samsung and the other copycats a lesson. Even before the iphone, Samsung was already known for being a copycat to whatever is the hottest device in the market. They have copied designs from a lot of Nokia devices in the past, like the N95, and also some Blackberry phones, etc. Now, they're copying iDevices. Difference is, unlike Nokia, Apple does not tolerate copycats.

This will be good for Samsung. If they learn from this, this would push them to grow and be more creative and innovative with their hardware and UI designs. They definitely already have the technology. They just need to come up with their own hardware and UI ideas.

Did you even read the ruling? I guess you did not.http://www.osnews.com/story/25098/Apple_Scores_Meaningless_Dutch_Court_Victory_Against_Samsung.
Apple only won because of the gallery app which Samsung is changing. Most of the design patient were rule invalid along with the other two patient.

Didn't you read the title? It said Apple won the case. Regardless whether Apple won on all complaints, they were able to have Samsung devices banned, or at least suspended from sale.

so.. the title is the whole story? the title is ment to grab your attention. the title ISNT factual.

Apple won on 1 of like 10 complaints. if you score 1 out of 10 tries in a game, your the loser most likely.

And that 1 wasnt even a major score...lol. Hardware woulda been MAJOR.

I can guarantee Samsung has big smiles on their faces. Especially since what they got sued for was actually in Android, not Touchwiz...if I'm reading the updated news correctly.

So Apple needs to just try to sue Google for Android. I would LOVE to see that one.

Apple is just scared of what business they will lose. People have the freedom of choice to either product. Seriously if apple has their way now the whole world will end up using only apple products.

It's not about Apple being scared. It's about protecting their investments. Apple banks a lot on their software and hardware designs. That's their bread and butter. Apple is also very religious in keeping their traditions and plans in releasing their products in accordance to their timeline. They are ahead of the game. But, there are other tech companies who are capable of matching their hardware technology, or even surpass it (like Samsung). That only leaves Apple with their innovative designs and robust software. If the others copy their product designs and UI (which sets them apart from the rest), it will disrupt Apple's masterplan and tradition of their product releases. Apple products would lose its uniqueness and premium status, and there would be no more reason why consumers would pay premium when there are other identical devices with better specs.

Sorry buddy, apple has already lost their uniqueness and premium status and there already is no reason why consumers should pay premium when there are other devices with better specs that do more and cost less or equal to. Apple is smart enough to know this, therefore trying to stifle the competition. Everyone can see this, so quit trying to pull the wool over our eyes.

The iphone and the ipad are still the bestselling devices. And yes, the only reason why the others are catching up is because they try so hard to imitate the iDevices. So don't talk as if iDevices no longer sell.
