Patent battles between Apple and Samsung are taking place on several arenas throughout the world, and a Dutch court in the city of The Hague is exactly one of them. Those who keep a close eye on things...

This is how good the Samsung Galaxy S II is. Apple isn't suing any other phone.
43. The_Miz (Posts: 1496; Member since: 06 Apr 2011)
If it's good, then why does it copy Apple?
61. Ionious (unregistered)
Because the GSII is not a copy of the iPhone.
If it is, please consult your doctor.

"dragging a slider in order to unlock the phone"
Call that copying?... most phones do that. Apple seriously sucks.
133. Heatfan316 (Posts: 248; Member since: 21 Aug 2011)
Well it's good to see all the apple fans happy, but if you read the article correctly it's says it was banned in the Netherlands, all I got to say is who cares, do any of us live in the Netherlands, we live in the U.S, guess what fanboys we get this phone in about a month, it will never be banned here, especially since Verizon is asking Obama to veto any device ban, so fanboys get mad at that.

if samsung wasnt violating the patents, then why did apple win?
165. cheetah2k (Posts: 727; Member since: 16 Jan 2011)
This article is wrong. Samsung phones will continue to be sold, albeit with a differing "Gallery" scrolling method.
What iPhonearena fails to mention, is that the judge determined that Samsung violated patent 2,059,868, which deals with "method of scrolling," and this is related to the viewing of pictures only.
Samsung says that it will replace the software that infringes on Apple's patent (the Gallery application, specifically), which should allow it to continue to sell the phones. Notably, that Gallery application is the standard Android one used in Android 2.3, which also explains why the Galaxy Tab 10.1 is not affected by this ruling. Less clear is what the ruling means for other Android phones that use the same application.
An unbiased write up can be found here

only 1 of 10 times were upheld by the court w 1 parent invalidate
not much of a win here for apple
change the gallery app or find prior art for it. . . not a big deal

yep Samsung will roll out a patch and continue selling

quite natural :)..on the bright side, i am anticipating a faster ice cream sandwich update for my SGS1 :D
3. PhoneLuver (Posts: 460; Member since: 05 Jul 2010)
Samsung has a lot to learn from ASUS. I really respect ASUS for thinking outside the box. Samsung has more than enough resources to come up with their own unique interfaces. BTW who said there was anything wrong with stock Android?
4. rycx365 (Posts: 37; Member since: 18 Mar 2011)
Samsung should stand up for the Apple trees and sue apple for copying their name
5. ChiquiKon (Posts: 58; Member since: 26 Jul 2011)
Samsung should work on a couple of updates, remove anything that might be patent infringement and keep on with Galaxy SII line. As PhoneLuver says, they have the resources.
People will soon get sick of all this suing madness.
46. The_Miz (Posts: 1496; Member since: 06 Apr 2011)
They should've did that the first time instead of copying Apple

122. remixfa (Posts: 13901; Member since: 19 Dec 2008)
do u actually read the real stories or do u just make dumb comments? my guess is the latter.. lol
if you actually read the updated article and forget all the sensationalism on PA, the ONLY thing that samsung got hit for was the one and only one patent that dealt with the gallery and how it registered swipes. Samsung already said it will send out and OTA to fix the issue. They arent actually banned.
166. idan (unregistered)
Isn't that why apple is paying Nokia for past and future phones. They should have invented GSM and 3g instead copying others.
Lol absurdity is a must!
6. ParaSky100 (Posts: 3; Member since: 24 Aug 2011)
At least only 3 phones will be affected by this. Their budget android phones like the Europa and the Fit won't be going anywhere.
7. gallitoking (Posts: 4630; Member since: 17 May 2011)
thats right... the SGII will not make even into the US the way things are going.. once the big head Samsung goes down.... we are going after the little fish... . I want to read all the fandroids.. rebuttals to this report.... 5....4....3...2....1....
21. wumberpeb (Posts: 392; Member since: 14 Mar 2011)
are you an idiot? do you really support this? whether or not you love your iDevice, do you really want one company literally booting their biggest competition out of entire countries one by one?
what good does that do, other than proclaim Messiah Jobs as an asshole?
39. gallitoking (Posts: 4630; Member since: 17 May 2011)
my support doesnt change anything.. wheter i support or not.. things are what they are... this has nothing to do with support... Apple will still be in business and so is samsung... so just pick a side and watch things unfold...

What up gallitoking? I survived the East Coast Earthquake. The first Earthquake I have ever felt. It's weird to have the ground shake like that, it felt so unnatural. Where I like it was only like a 2.0 but still it was something to behold! In Virginia it was like a 5.9 so that is kinda on the bigger side! Anyway I don't get how people think the iPhone 4 & the Galaxy S II look alike? One has a huge screen the other is small, one is made of glass & the other plastic. What gives? Also power up both phones & you will see the difference, TouchWiz & iOS don't look alike. All you need to do is hold both phones in your hands & SEE the difference. The Netherlands & Germany must be blind. I just don't see how you can confuse them both. You can put a blind fold on & just feel the difference. Glass feels different than plastic! This is crazy!
53. gallitoking (Posts: 4630; Member since: 17 May 2011)
wow dude good that you are ok. man... good to hear that... for us is hard for us to not distuinguish between the iphone and the samsung copyphone... but for people out there... if they thing the iphone4 is 4g.. camon.. dont you thing they can easy confused them too... again... for them not for us.. i dated twins once.. i could distingush them but most people couldnt. i could see many diferences.. but most people couldnt... maybe is what happening here.. except they are not twins.... they are clones..lol ..sorry had to trow that in there
75. remixfa (Posts: 13901; Member since: 19 Dec 2008)
the infringement is so generic they will use this to go after all competition in that country. A slide unlock .. really?? Wtf.
92. Dman (unregistered)
Don´t worry remixfa.
It has already been updatedhttp://www.engadget.com/2011/0
The only patent infringiment is the scrollable gallery.
A simple update will solve it. And it actually is something from Gingerbread 2.3.

I want to see competition this is a very bad decision. They do copy the iPhone but I rather just see a fine or something. A large one at that.
28. SuperAndroidEvo (Posts: 3447; Member since: 15 Apr 2011)
biophone, that is reasonable & makes sense. No competition is bad for the mobile industry. Banning products is just plain stupid!
51. darth8ball (Posts: 519; Member since: 02 Aug 2011)
Which only proves Apple doesn't care about it's customers, only it's bottom line. But isn't it the customers that give you that bottom line?
I just don't understand how any reasonable adult in America living in todays financial times could give money to a company that wants to make the financial outlook of a country worse than it is now.
29. protozeloz (Posts: 5284; Member since: 16 Sep 2010)
this is not gonna stop them as Samsung is already on a workaround, and will continue sellinghttp://goo.gl/A5EiG and you really want competition to be gone? you know that will halt the way things are going?
30. protozeloz (Posts: 5284; Member since: 16 Sep 2010)
also Google has found some patents on Motorola that could make things interestinghttp://www.bloomberg.com/news/
47. The_Miz (Posts: 1496; Member since: 06 Apr 2011)
Fandroids will as usual backpedal and say "competition" is good. Yeah, sure it is. But copying someone else's design isn't competing. It's patent infringement.
56. waveydavey (unregistered)
Unless, of course, said patents protect ideas as vague and far reaching as those involved here. Everyone who knows anything about patents agrees that these types of broad patents hurt innovation and prohibit variety in the market.
60. snowgator (Posts: 3149; Member since: 19 Jan 2011)
As Apple starts to win legal battles - HTC here in the States, the Netherlands now- it is becoming more and more apparent that these handsets are violating Apple. Kinda hard to keep fighting the good fight when you are losing. Samsung needs to fix these things, HTC needs to work out a compromise, Motorola needs to deal with Microsoft, and we can all go back to tech talk instead of legal speak.
71. darth8ball (Posts: 519; Member since: 02 Aug 2011)
Who copied who.
The first touchscreen phone was the IBM Simon, launched in 1992. During this decade the popular iPaq (not made by Apple by the way) was launched with touchscreens and optional phone attachments. HTC, the leader in touchscreen phones up until the iPhone and makers of phones like the Nexus One launched their first touchscreen phone, the HTC Wallaby aka XDA in 2002. Apple did actually make a concept for a touchscreen phone (not a mobile, a regular landline phone) way back in 1984!

Get over yourself Apple won! Apple would not win if they didn't have a legitimate case.
Deal with it!
104. daveywavey (unregistered)
You are incredibly naive. By this logic, OJ was not guilty, the guys at Enron did nothing wrong, and common criminals aren't guilty because of legal technicalities. Maybe if you left your computer long enough to form an original thought, you'd realize that.
106. taco50 (banned) (Posts: 5506; Member since: 08 Oct 2009)
Well considering Apple is winning multiple patent cases and any reasonable person can see the copying I'd say I'm not naive at all.
The problem is this website is full of andrones who bash Apple constantly for everything and refuse to give them any credit. Apple won the case. Game over.
114. daveywavey (unregistered)
I think you'll find my commentary to be quite the opposite of one sided. You may, however, want to take a look at your ridiculous, inflammatory language in the clear light of your poingnant observation.
137. remixfa (Posts: 13901; Member since: 19 Dec 2008)
Taco, international law is not american law. the standards of proof are not the same. If it had a strong case, the american courts wouldnt have thrown out apples request to ban samsung products in america.
apple won on a small thread of code that is easily updatable and fixable and samsung already said they are going to push an update long before the october deadline.
do you actually read or do u just talk to hear your own voice? lol

Apple has turned into another Micro$oft.
Apple are the rebels against IBM, M$
9. serious (unregistered)
Wow Apple.. just wow.
keep this up and Apple will eventually see their consumers get angry.. people in general like to see the underdog win.. the "good guys" victorious.
Apple will be seen as a terrible entity trying to dominate using dirty means.. regardless if it's within their right or not, the public won't like it and Apple will fall.
They make awesome hardware and are great phones, they should be focusing on innovation, not these pathetic methods of trying to prevent competition.
I will NEVER buy another Apple product... not for me, not for my kids.

the point here that many people ignore is that samsung won case against 2 patents and lost one 1.
Samsung has already announced that they will soon be releasing small update for galaxy s, galaxy s2 and ace that will have different scrolling mechanism and photo management.

14. dandirk (Posts: 187; Member since: 04 Aug 2011)
Has it been confirmed that Apple's case is based on Samsung's Touchwiz and not general Android stock features?
If it is touchwiz... Then o-boy don't feel too sorry for them, since they did it to themselves and at any point could have changed them. If it was Android to blame, then it would really suck to be Samsun, stuck between and rock and a hard place.
I am guessing they have updates ready to send out, in case they lost the UI patent cases.
The question will be how long will it take for Samsung to reverse the order?
17. jura21 (Posts: 30; Member since: 20 Jun 2011)
both android and samsung....coz its about the lockscreen (touchwiz has a custom one) and gallery app(core android 2.3 feature)...however,now with the honeycomb gallery app,the judge ruled no infringement, so samsung just have to put the honeycomb(or any other gallery app) on their phones
22. ilia1986 (unregistered)
Do tell me please just how Touchwiz resembles iOS? Please do - I am anxious to hear - how this:
Or maybe it's Android?
Do tell kind sir.
35. biophone (Posts: 1879; Member since: 15 Jun 2011)
The app drawer in touchwiz looks like apple's home screen. I dont care if it is displayed in a different part of the phone and not in the home screen it still looks like the ios verison.
