is it me, or does it seem that this would go off randomly? i see it being set off by the actual user more times than this would actually work... but hey, i could be wrong...

I agree. I think it should be a two sided app. One side is a program that runs in the back ground and is constantly connected. The second side is installed on your windows machine or macintosh. If you come to find your phone is stolen or lost, activate the program and it allows you to see where your phone is via the built in gps that is awakened by the internet connection on the phone triggered by the computer program. If it is discovered that the phone is stolen and not just lost, the program provides the ability to send up to date gps coordinates the local authorities so that the violater can be apprehended and ultimately your phone returned. This method makes it so that only the user can initiate action. My 2 pennies.

I'm pretty sure Apple knows what it's doing. I can't wait for this because Im always pretty freaked out about getting my phone stolen.
