Apple scores a EU-wide ban on sales of the Samsung Galaxy Tab 7.7, but 10.1 is free to roam
0. phoneArena posted on 24 Jul 2012, 06:44
A German court today upheld the injunction against the Samsung Galaxy Tab 7.7, so the tablet is basically banned from being sold and marketed in the European Union for infringing on Apple's iPad design patents. It was just last year when Samsung was frantically trying to hide it from the IFA show floor in Berlin when it learned about the lawsuit filed against the slate, but that obviously didn't help...

"Should Apple continue to make legal claims based on such a generic design patent, design innovation and progress in the industry could be restricted."

This is what I mean about Apple's approach. C'mon pretty soon they are going to patent the actual rectangle so no one can use it. Kids at schools will now have square notebooks & textbooks.
This is just silly at best now.

Yet another ban courtesy of Apple paranoia because of the impending iPad mini..
The dirtiest strategy of all - banning competitive products instead of competing with them.

not sure what happened to my original post. I dont follow much on the iSue stories and I didnt read the whole articule but I wonder if this has something to do with the iPad mini coming out. Maybe Apple wants to solely control that part of the tablet market

If you wanna see what is unfair, please go to a German court.
If you wanna see what is bias , judge Koh is the answer.
If you wanna see what is justice, the Netherlands is the perfect example.

the UK is justice. they're even making apple issue a formal apology in an ad that has to run for 6 months saying samsung did not infringe on our products. the best part, they filed to appeal and got the same judge

Seriously apple, If your so scared about competitors and how great their products are, why not do the smart thing and make something that is incredible. because we all know you aren't really suing for the fact it looks like an ipad (honestly, it doesn't even look close) and change that mobile operating system of yours, I even laugh when I see the words, ",the most advanced mobile operating system in the world," because it isn't advanced, its plain and simple and really needs a change, your lucky your not getting sued for that drop down notifications panel.
Grow up apple

I'm a little lost on this. For what reason did to 7.7 get banned?
20. bobfreking55 posted on 24 Jul 2012, 08:06 4 1
i think it's because it's near the iPad Mini's 7.85...
:/ god i hate apple.

So Apple can ban a product for when their product hasn't been released or the fact that it hasn't been officially announced yet? Sounds like Tim Cook got on his knees to serve the judge.
16. Mitchel posted on 24 Jul 2012, 07:27 3 1
Is it me or i find it ridiculous?! Galaxy tab 7.7 got banned even when Apple has yet to be announced their iPad mini 7, while the Galaxy Tab 10.1 which is direct competitor of iPad didn't get banned? o_O
19. sprockkets posted on 24 Jul 2012, 07:47 1 0
Why does a German court's ban on the 7.7 apply EU wide?
It doesn't. In fact, the "ban" is so lame, that resellers can still buy it from Samsung Korea instead of the german subsidiares, not advertise it but still sell it, and be perfectly legal in Germany.

I think the rumor that apple is going to make an ipad mini or whatever they wanna call it, should be out of the picture. Apple won an injunction for the galaxy tab 10.1 design that closely resembles the ipad2. (samsung lawyers can't even distinguish the difference remember?) galaxy tab 10.1 was ready for release last year but when they saw how thin the design of ipad2 is, they went back to the drawing board to build the new galaxy tab 10.1, that same tab they lost the injunction with. Even if they shrunk it to 7.7 it still infiringes ipad2 design. The tab 10.1N is an exemption because we all know what it looked like after the wrokaround, like the htc flyer. I know apple has become a lawsuit machine but this time, samsung really lost it.
25. true1984 posted on 24 Jul 2012, 10:39 3 2
i remember apple lawyers photoshopping the galaxy tab to look like the ipad in order to mislead the judge. but for the thing you said i'd need a source before i beleive that
30. LionStone posted on 24 Jul 2012, 16:28 0 2
Yea Samsung went back to make it thinner, big deal! What, apple has a patent design on thinness!? Ridiculous. Everyone knows it and apple is only losing customers each day this crap continues.

i think samsung should find a permanent solution for this or make a slightly different design, packaging and become secure like microsoft.....ms copied the gui and pointing devices from apple but they have managed to survive without a lawsuit...apple also owns some patents to sue the ultrabooks but they never even think to do that, i believe nokia is free from patent wars because they use wp os......how did ms escape from most of the lawsuits? they also earn a lot from all the android phones but google is not worried about it......i just don't understand why? how? are we more interested in phones and tablets than in pcs?

Community Design should go away all together. If you've ever seen the submission by apple, you will see a lot of competitor's product designs being submitted just because they can and the fact that Community design requires no real validation outside of name and address

apple's first iphone was innovation for the time
now they are doing the exact opposite
31. mrbtree posted on 24 Jul 2012, 19:24 2 1
ipad mini 7.85 inch screen
galaxy tab 7.7 inch screen
coincidence that apple is banning a product that they will be battling straight away when their ipad mini comes out.
And in Australia Apple and and Samsung are also fighting the patent wars but the judges husband works for the firm representing apple and she herself used to work for said firm.
