0. phoneArena posted on 17 Oct 2012, 14:43

Apple has received another round of ammunition it can use in its legal battles against Samsung, a patent from the USPTO for the original design of the Apple iPad; the application was made one day before Steve Jobs introduced the product and the patent is credited to Steve Jobs and Jony Ive among others...

USPTO: proving once again, money reigns supreme... along with stupidity, cant forget stupidity!

speaking purely objectively, those two statements are decidedly opposite to today's capitalistic world.

Oh let them keep their napkin design; we don't want that horiiD bulky iBrick anyway!

Well Mxyzptlk, I don't think you have 2 worry about anybody wanting to steal your intellectual property.Even Apple isn't that desperate :-)

Who cares, I'm happy they didn't patent edge2edge rearflat candybar looking phones
like the Sharp Aquos!

16. theBankRobber posted on 17 Oct 2012, 15:52 1

What's wrong with that? Its better to have something to protect yourself from a company like Apple instead of suing everyone over something so generic.

So is my black leather folder that holds a pad of paper and a pen in danger too?

7. andro. posted on 17 Oct 2012, 15:02 3

Perhaps if it has a clear plastic window panel on it allowing you to see the internals then yes the folder manufacturer could quite obviously had the sheer cheek to copy apples beloved generic black rectangle design

5. andro. posted on 17 Oct 2012, 14:59 14 1

More stupidity again, its pretty much certain the patent means anything "rectangular and black" and nearing 9.7 inches in size is a copy of the ipad.

10. PAPINYC posted on 17 Oct 2012, 15:13 1

Is it really 9.7 inches?

6. ibap posted on 17 Oct 2012, 15:00 1

Was Microsoft aware of this and that is why the Surface has such an odd form factor?

If you get bored, check out some of the other design patents Apple references in this one. Everything from a woman's compact to the LG EnV.

Thank God the automotive industry doesn't work this way, if it did we'd all be driving Edsel's.

26. Mxyzptlk posted on 17 Oct 2012, 19:15 1 5

Apple isn't putting a gun to everyone's head and forcing them to buy their products. They are only protecting their own inventions. They aren't stopping competitors from coming out with their own devices as long as they don't copy their designs.

30. BrockSamson posted on 17 Oct 2012, 20:46 4 1

Except that it isn't their invention and are they aren't doing this to protect themselves...

39. No_Nonsense posted on 18 Oct 2012, 22:05

So according to you, we didn't have rectangular phones/tablets before the iPad, pinch to zoom, rounded corners, etc on a phone before Apple's iPhone (and iPad).

14. schelle posted on 17 Oct 2012, 15:44 4 2

Apple have had their glory moment, take it like a man and realize that you no longer are the best. And let other evolve and earn money in an honest way !!!

15. DOGIEFRESH posted on 17 Oct 2012, 15:47 3 12

If this happen to be to other way around like SGSIII patent granted for 4.7 inch plastic design Fandroids will be cheering like world series parade and call it the most fair thing ever in US trade history....!!!

17. roldefol posted on 17 Oct 2012, 16:01 9

People are so quick to jump down Apple's throat not because they filed for or were granted design patents, but because they're trying to litigate them. Every device maker has a right to patent his design, but Apple is the only one who used a very simple design patent to try to force a main competitor completely out of "its" market.

18. CDGMobile posted on 17 Oct 2012, 16:12 3

We all know that every company files patents but the problem with Apple is that it is the first to sue for the infringement of intellectual property, even though they themselves do the same, well just have to wait to see if Apple can just not sue anyone over this particular patent. Personally I'm hoping they prove me wrong and stay out of court

28. someones4 posted on 17 Oct 2012, 19:20 2

I agree. Too bad, knowing that a monopolistic company such as apple will always enforce the rules. No matter. I'm very sure many companies can come up with a better design than the iPad.

19. som posted on 17 Oct 2012, 16:49 1

US Patents just wanted your money, they didn't care if it is a none working products. Your money can buy a patent on anything and ideas. This Patent Laws are useless in actually life only to stall new technology and innovative.

36. CDGMobile posted on 18 Oct 2012, 08:13

This is very true Som, the patent laws are made just to fund useless parts of companies, and the legal system. That money should be redirected into the R and D departments, if people actually focused on making new products instead of saying hey you copied me we'd be way farther as a culture

20. Bluesky02 posted on 17 Oct 2012, 17:23 2

The good news for Apple - They received the patents
The bad news for competitions - Apple will rampage with lawsuits

21. sprockkets posted on 17 Oct 2012, 17:50 2

I don't see this as bad news. The patent should be exactly the ipad design, not the bull s**t one that is so generic that everyone is being sued with.

No round home button? No same speaker placement or connector? Done, not infringed.

22. flamencoguy posted on 17 Oct 2012, 18:18 3

It is a very unfair world. Motorola, Samsung and Nokia does all the hard work to come up with the real inventions to allow phones to work with 3G, 4G LTE and other real scientific discoveries. But because they are part of a standard they are deemed to be FRAND patents and get very little royalties for them. Also they are obligated to license them to virtually any one. By contrast Apple's patents are gimicky, simple, obvious and used mainly to ward off competition.
Fact: Apple receive 676 patents in 2011 Samsung over 4000 just behind IBM.
Apple received 4100 patents in the previous 10 years average 410 a year.
I bet most of them are about as substantial as the "slide to unload' and "rubber band effect" ones.
To Apple fans: we don't hate Apple just because we are envious. It is because they are sly and slippery. They used "reality distortion field" developed by Steve Jobs.

23. InspectorGadget80 posted on 17 Oct 2012, 18:37 2

Jeezes USPTO how much MORE THEY CAN BE SO STUPID to take Capple's free money givng them the original patent design for this? THIS IS FULL B.S.

"Apple have had their glory moment, take it like a man and realize that you no longer are the best. And let other evolve and earn money in an honest way !!!"

No kidding right? It is pretty pathetic that yes they once had their glory day and stuck to honest business then but now android has gained steam and has surpassed them. So what do they do, start playing the childish low balling games of suing for crap reasons. One of their complaints if i'm not mistaken was they were going at Samsung for the way in which they had their icons laid out. Square icons in a grid, funny considering the flip phones i had nearly a decade ago with the 1.3mp camera (top of the line at the time lol) had "square icons laid out in a grid manor" and by golly it was a samsung-LONG BEFORE APPLE HAD A PHONE-.

Now I'm not saying apple is infringing I really don't care about that s**t. The reason this s**t was made is for the people making Fake knock off China made Samsung galaxy S3's and the like. Yes there are also apple knock offs and ipod knock offs, THOSE are what they should be enforcing their patents upon. NOT the hard working engineers/designers etc that are legitimately trying to push the technology envelope.

Apple can't hang and are steadily but surely losing business to Android and Samsung directly. So rather then hire the right people and push your team to come out with a superior product where the public has no choice but to choose theirs because its so amazing. They choose to hit the floor and kick, scream, and cry that the competition has met and beat them. So they take the only route they have left the courtroom where they can't fight some albeit legal battles but pussy and immoral ones. This is just one of the MANY i repeat MANY reasons i choose not to give my business to Apple + crap combined(apparently the word is banned....REALLY?).

/ Rant end

27. someones4 posted on 17 Oct 2012, 19:18 1

Yay!! Finally you can patent "ornamental designs". Think of how Nike and Adiddas or Puma will kill each other. Every car company will burn. Electronic appliances will unite under a single brand.

29. rusticguy posted on 17 Oct 2012, 20:37 1

Great .. love American way of fair play. Bulls**t.

31. networkdood posted on 17 Oct 2012, 22:02 2

Wow, what a joke...oh well, who wants to copy a boring OS and its design now?? No one.

32. networkdood posted on 17 Oct 2012, 22:03

So, can't Ford and GM patent their designs now as well as chair manufacturers? I mean this has broad implications and not in a good way.

34. JunkCreek posted on 17 Oct 2012, 22:38 1 1

So, Google MUST HAVE PATENTED 7" DISPLAY DESIGN!!!

35. Twisted247 posted on 18 Oct 2012, 05:02

The electronic division of patents is known for being not as strict as grabbing a patent for other areas.. unfortunately, wish the residing judge would just say knock the childish s**t off and case dismissed

37. PhoneCritic posted on 18 Oct 2012, 09:50

UNbelieveable!!!! The US Patent office is absolute Joke. Who is handing out these patents Patrick from sponge Bob square Pants?

All I can say is that I see a building of a Monopoly here and all it takes is one small company to bring an Antitrust law suit and wham!! It's over for Apple as we know it - Broken up into the Os division and the design division never again to work together. Apple be real careful here real careful ruling the playing field can be detrimental to your health said the attorney Generals of each state.
