Apple, Samsung CEO-level talks fail to produce any agreements

According to the Korea Times, that CEO-level meeting between Apple and Samsung ordered by California Judge Lucy Koh ended up producing nothing in the way of any agreements that would help both sides reach a settlement over their patent battles...

The only time a settlement discussion produces a settlement is when both parties aren't certain about the outcome and the downside is compelling. Apple feels they have the upper hand. Until they cease to feel they have the upper hand, there won't be any meaninful move to settle the case.

I know that taco is a troll, but it does read as:
Apple says that Korean based Samsung copied its designs while Samsung feels that Apple should license its wireless patents.
So, Samsung is not really denying that they are copying...but seriously - touch screen phones with a rectangle shape...and then the HTC issue with how documents are being formatted....really pushing the envelope....

And to correct you, it's more like "Hey, I know you think we're copying your s**t. And although we think you're wrong and you're overreacting, we'll gladly pay you money for the stuff you claim we're copying."
The other angle is the question: even if Samsung is implementing design choices patented by Apple, should there be patents on those choices to begin with? Should Apple really have a corner on curved edges and a list of possible apps to open a link? Every customer to whom I've had to explain why the Evo 4G LTE isn't out yet has expressed shock and disgust at the pettiness of the patent involved in the lawsuit that Apple won. None have said "well, HTC shouldn't have used the design then." Not even the Apple product owners.

I doubt that's was really said.. why because no ones offers money or settlement if they are not at guilt.. and btw Apple doesn't claim Samsung is copying.. they are certain....

Google offered a settlement to Oracle about a year ago, and they just won that lawsuit.

this show that you don't know how the law works... Apple is bigger than Oracle.. if little Oracle says Giant Google infringed in patents the judge will not act the same as if it was Giant Apple vs. Samsung whom is smaller than Google.. please Google other articles to find more about this.. even Samsung is admitting guilt when all the fandroids were saying that Apple did not had a case..

Yeah, they do all the time, because litigation is time consuming and expensive. Most suits are settled, with no admission of guilt, just to move on. It's why patent trolls exist. They don't want to go to court, they want to get a settlement. Apple is a whole new type of patent troll. Their goal isn't money, its to stymie competition, slow it to their pace or slower.

Where do you see Apple winning? Certainly not in market share. The case hasn't even started. No one is winning yet. The consumer is getting his ass kicked, that's for sure. Apples record in these patent lawsuits us spotty at best.
And, I'm pretty sure either you or Taco (or both) were declaring Oracle winning a few weeks back. How'd that turn out for ya?

It's only obvious to slobbering Apple fanboys. To the rest of the world, its just silly. That's the reason Apple and its cult always need to show pictures of Samsung phones scaled down to iPhone size, and with the app drawer open. If you show the actual phones side by side, as they actually operate (homescreen to homescreen), it becomes blatantly obvious that Apple really is suing over rectangles.

As far as copying the design, if you try to go for a minimalistic look, it will look like other products doing the same. In that event, you're saying that apple has the right to patent that?
Apple has been going after anyone who is even in the vicinity of copying them. Hell, they brought a lawsuit against the city of New York for a PR design for tourism. The logo had an apple on it. It wasn't bitten, but apparently apple feels they're the only one who can have the image of an apple on their s**t. I kinda hoped that would've gone to court, since prior art was in the Big Apple's favor.
I think the only way you and gk are going to see the dangers of being able to patent a design as similar as the iphone to a samsung phone is if you stop and think about how many products look similar to each other. Cordless phones, HDTVs, laptop & desktop computers, toasters, microwaves, ranges, refrigerators, washers & dryers, home audio equipment, dvd players, etc., etc., etc. How many lawsuits have been brought in these industries? What would happen if they decided to follow apple's suit. For some things, there are only so many different designs that can be used before they interfere with use of them. Apparently the manufacturers in these industries can get by without having to sue each other into oblivion, so why can't apple? As I've said before, if they were only suing for a monetary settlement or licensing, I wouldn't have a problem with that. But when they're suing to block sales that's an entirely different matter. IMO, the only reason to block sales of something is if the products is dangerous, or if the manufacturer fails to compensate the injured party. Anything else is anti-competitive and monopolistic, plain and simple. If every company did this, imagine what the cost of these items would be with only one company supplying them, with no competitors. They could name their price and if the consumer doesn't want to pay it, where else could they go. A monopoly, or even a duopoly, only are good for the companies in them, and a detrement for everyone else.
