Android Market now offers widgets for Sense UI enabled phones

We reported the other day that HTC had sent a C&D letter to the maker of Beautiful Widgets, LevelUp, in effect killing off the $1.50 app. The app was designed to give your Android phone the similar look of HTC's home page on your device. You know what we're talking about, cellphone fans. You've gazed at pix of the HTC home screen with the large flip clock and the weather animation and thought how cool it looks. But the C&D letter was like stabbing a knife through the heart of the third party download. HTC is getting into the business itself by offering a package of four widgets that will work only on the Hero and the DROID ERIS. The widgets are Today in History, Dice, Tip Calculator and Battery. Not the most exciting foursome, but hey, you can't beat the cost (Free) and you can stick it to those friends of yours who have been pushing their DROID in your face.

How can displaying the date and weather on your cellphone constitute breach of any patent? Should just changing a color scheme, color or font suffice in circumventing this Nazi-like restriction by the HTC? Or did HTC get a patent for the words, clear, sunny, snow, January, 2010 etc.etc.
