imate kjam forcing 3g enabled?

I've just piked myself up a I-Mate Kjam for free through work, but unfortunately i am with the service provider in australia known as 3, and it works on a 3g system where the sim cards will only work in phones that are 3g enabled. and to my disapointment ive noticed that the imate kjam is not 3g enabled but the jasjam is 3g enabled (dammit). i was wondering firstly if this 3g enabled is a hardware feature of a phone or a software feature? and secondly if it is a software feature is it possible to somehow make the kjam 3g enabled? as i would really like to use this phone but will cost me far to much to opt out of my contract with 3
